Multilateral Compliance Mechanisms in EU Environmental Law

Prompted by recent events in the EU's international environmental cooperation, this thought-provoking book explores the establishment and use of multilateral environmental compliance mechanisms as part of the EU's external environmental action. Expanding upon current discussions in external relations law, this timely book uses a doctrinal approach to analyse EU engagement with a key instrument of international environmental governance. The author examines the role of compliance mechanisms in EU environmental action, from establishing these treaty-based mechanisms within EU legal boundaries, to utilising non-compliance decisions at EU level. The book concludes with an evaluation of the extent to which EU law enables the EU to preserve, protect, and improve the global environment with the aid of compliance mechanisms, as required by its own Treaties. Multilateral Compliance Mechanisms in EU Environmental Law will be an essential resource for scholars in environmental law, European law, international relations, and public international law. It will also be beneficial for EU officials and policymakers, and environmental advocates and campaigners.

Rule of Law for Nature

  • Categories: Law

'Human laws must be reformulated to keep human activities in harmony with the unchanging and universal laws of nature.' This 1987 statement by the World Commission on Environment and Development has never been more relevant and urgent than it is today. Despite the many legal responses to various environmental problems, more greenhouse gases than ever before are being released into the atmosphere, biological diversity is rapidly declining and fish stocks in the oceans are dwindling. This book challenges the doctrinal construction of environmental law and presents an innovative legal approach to ecological sustainability: a rule of law for nature which guides and transcends ordinary written laws and extends fundamental principles of respect, integrity and legal security to the non-human world.

A comprehensive analysis of the European Commission's general role in supervising member state compliance with EU law, this book provides a detailed assessment of centralized EU enforcement. It starts out by asking whether it is viable to establish stronger Commission powers of enforcement at this point in time. Against this backdrop, and as a means of exploring the role of the Commission, the chapters examine a number of different aspects pertaining to enforcement of EU law. Beginning with an appraisal of the Commission's function under the general EU infringement procedure stipulated in Articles 258 and 260 TFEU, the volume argues that the EU lacks independent self-sustained regime authori...

Global Themes and Local Variations in Organization and Management: Perspectives on Glocalization offers a broad exposition of the relations between the global and the local with regard to organizational and managerial ideas, practices, and forms. This edited volume forges ahead to capture the complexity of modern management and organization that results from the processes of glocalization. Universality is among the core underlying principles of the management of organizations, as well as of organization and management science itself. Yet, reality reveals enormous variation across social and cultural contexts. For instance, multinational corporations must adjust their management practices to ...

Refugees and Religion

This book is open access and available on www.bloomsburycollections.com. It is funded by Utrecht University and the Max Planck Society. Understanding religion from a material and corporeal angle, this book addresses the ways in which refugees practice their religions and convert or develop new faiths. It also evaluates how secular institutions in Europe frame and determine what is classified as religion according to the law, and delineate the limits of religious authority, religious practice, and religious speech. The question of nationalism and migration has been shaping the political landscape in Europe for more than a decade, resulting in a nationalist upsurge. This volume places the current trajectories of people from Asia and Africa who flee from conditions such as oppression and conflict, and who are seeking refuge in Europe in a broader historical and comparative perspective. In so doing, it addresses past experiences in Europe with the role of religion in both producing and accommodating refugees, in the aftermath of the Peace of Westphalia, World War II, and in the context of the Cold War.
