International Environmental Law and Policy in Africa

  • Categories: Law

C.O.OKIDl1 I welcome the opportunity to prepare a Foreword to the book on Environmental Policy and Law in Africa, edited by Kevin R. Gray and Beatrice Chaytor. It is a pleasure to do that because the book is a contribution to the cause of capacity building for development and implementation of environmental law in Africa, a goal towards which I have had an undivided focus over the last two decades. There is still some belief in and outside Africa that for developing countries in general, and Africa in particular, development and implementation of environmental law is not a priority. This belief prevails strongly in many quarters of the industrialised countries. In fact, the view is held either out of blatant ignorance or by some renegade industrialists who fail to appreciate Michael Royston's 1979 thesis that Pollution Prevention Pays.2 That group, for obvious reasons, must have their correspondent counterparts in Africa to provide hope that industries rejected as derelict in the West or inoperable due to rigorous environmental regulation, can find homes to which they can escape and dump their polluting industries.

"Defying all odds, governments participating in the global climate negotiations at Bali, Indonesia reached agreement on a roadmap towards a global climate change agreement to be completed by the end of 2009, ready to fill the gap when the commitments under the Kyoto Protocol expire in 2012. The contributions in this book examine some of the most difficult and controversial questions that global climate change negotiators face between now and the emergence of a 'Copenhagen Protocol' in 2009, and even beyond. Written by authoritative experts in the field, the various chapters are organised around the four principal elements in the Bali Action Plan - mitigation, adaptation, technology and financing - presented from different country, stakeholder and political perspectives."--BOOK JACKET.

This multidisciplinary volume presents a refreshing new approach to environmental values in the global age. it investigates the challenges that globalization poses to traditional environmental values in general as well as in politics and international governance. Divided into five parts, the book investigates how environmental values could be reconceived in a globalizing world. Part I explores contemporary environmental values and their implications for a globalizing world. Part II examines the development of Western and Eastern environmental values Part III discusses contemporary environmental politics Part IV examines how values inform environmental governance and how governance solutions influence which values are realised Part V concludes the volume with two different views of the prospects of environmental values in a globalising world. This study will be of great interest to students and researchers studying the environment in philosophy, political science, international relations, international environment law, environmental studies and development studies.
