This book is divided into three sections, including Cases by Justices, Guiding Cases, and Typical Cases, which will introduce readers to Chinese legal processes, legal methodology, and ideology in an intuitive, clear, and accurate manner. This book presents cases selected by the trial departments of the Supreme People's Court of China from their concluded cases. Law as an Instrument
How can the law be employed pragmatically to facilitate development and underpin illiberal principles? The case of contemporary China shows that the law plays an increasingly important role in the country's illiberal approach to both domestic and China-related global affairs, which has posed intellectual challenges in understanding it with reference to conventional, Western legal concepts and theories. This book provides a systematic exploration of the sources of Chinese law as pragmatically reconfigured in context, aiming to fill the gap between written and practised law. In combination with fieldwork investigations, it conceptualises various formal and informal laws, including the Constitution, congressional statutes, supreme court interpretations, judicial documents, guiding cases and judicial precedents. Moreover, it engages a theoretical analysis of legal instrumentalism, illuminating how and why the law works as an instrument for authoritarian legality in China, with international reflections on other comparable regimes.
The Subtle Logics of Knowledge Conflicts in China’s Foreign Enterprises
This book investigates knowledge interactions in China’s foreign enterprises. It reveals that cultural differences strongly account for knowledge-related obstacles, namely knowledge leakage and insufficient knowledge sharing. Contrary to conventional wisdom, however, widespread cultural arguments such as Confucianism or collectivism hardly apply to Chinese employees’ handling of knowledge. In fact, more subtle cultural logics are relevant in daily work, which are connected to the perceived stability of the enterprise itself. But these usually go unnoticed. Thus, rather than being distracted by a national “Chinese culture”, managers can take real action to solve knowledge conflicts in their particular enterprise.
Evolutionary Governance in China
The People’s Republic of China has experienced numerous challenges and undergone tremendous structural changes over the past four decades. The party-state now faces a fundamental tension in its pursuit of social stability and regime durability. Repressive state strategies enable the Chinese Communist Party to maintain its monopoly on political power, yet the quality of governance and regime legitimacy are enhanced when the state adopts more inclusive modes of engagement with society. Based on a dynamic typology of state–society relations, this volume adopts an evolutionary framework to examine how the Chinese state relates with non-state actors across several fields of governance. Drawing on original fieldwork, the authors identify areas in which state–society interactions have shifted over time, ranging from more constructive engagement to protracted conflict. This evolutionary approach provides nuanced insight into the circumstances wherein the party-state exerts its coercive power versus engaging in more flexible responses or policy adaptations.
