The Next Pope

Watch the Highlights Video of the June 24 live panel discussion from Rome.??????? When Pope Francis' pontificate has passed, it's very likely that one of the nineteen cardinals featured in these pages will be elected to become the next Supreme Pontiff of the Catholic Church, the spiritual leader of over a billion Catholics and the most influential and widely respected moral and religious figure in the world. Yet outside the Vatican walls, despite the considerable roles that some of these men play in the Church and in the world, few of them are known by the public — or even by their brother cardinals. Hence this book, an engrossing and thoroughly documented instrument through which a future...

Mediation

Mediation provides an attractive alternative to resolving disputes through court proceedings. Mediation promises just results in the interest of all parties concerned, a reduction of the court caseload, and cost savings for the parties involved as well as for the treasury. The European Directive on Mediation has given mediation in Europe new momentum by establishing a common framework for cross-border mediation. Beyond Europe, many states have tried in recent years to answer the question whether, and if so, how mediation should be regulated at a national and international level. The aim of this book is to promote the understanding and discussion of regulatory issues by presenting comparative...

This book proposes a principled approach to the regulation of dispute resolution. It covers dispute resolution mechanisms in all their varieties, including negotiation, mediation, conciliation, expert opinion, mini-trial, ombud procedures, arbitration and court adjudication. The authors present a transnational Guide for Regulating Dispute Resolution (GRDR). The regulatory principles contained in this Guide are based on a functional taxonomy of dispute resolution mechanisms, an open normative framework and a modular structure of regulatory topics. The Guide for Regulating Dispute Resolution is formulated and commented upon in a concise manner to assist legislators, policy-makers, professional...

This book demonstrates that the principles of textual criticism—borrowed from the fields of classics and medieval studies—have a valuable application for plagiarism investigations. Plagiarists share key features with medieval scribes who worked in scriptoriums and produced copies of manuscripts. Both kinds of copyists—scribes and plagiarists—engage in similar processes, and they commit distinctive copying errors. When committed by plagiarists, these copying errors have probative value for making determinations that a text is copied, and hence, unoriginal. To show the efficacy of the newly proposed techniques for proving plagiarism, case studies are drawn from philosophy, theology, and canon law.

English summary: This book deals with problems of long-term contracts - a central field of research for economists but, surprisingly, less so for lawyers. Building on the insights developed by economists, it focuses on five problems of paramount importance for long-term contracts: good faith and fiduciary duties, change of circumstances and force majeure (including contract design, risk distribution and renegotiation), termination for cause and, finally, penalty clauses.
