In many societies, histories of exclusion, racism and nationalist violence often create divisions so deep that finding a way to deal with the atrocities of the past seems nearly impossible. These societies face difficult practical questions about how to devise new state and civil society institutions that will respond to massive or systematic violations of human rights, recognize victims and prevent the recurrence of abuse. Identities in Transition: Challenges for Transitional Justice in Divided Societies brings together a rich group of international researchers and practitioners who, for the first time, examine transitional justice through an 'identity' lens. They tackle ways that transitional justice can act as a means of political learning across communities; foster citizenship, trust and recognition; and break down harmful myths and stereotypes, as steps toward meeting the difficult challenges for transitional justice in divided societies.
A rich collection of interdisciplinary essays, this book explores the question: what is to be found at the intersection of the sensorium and law’s empire? Examining the problem of how legal rationalities try to grasp what can only be sensed through the body, these essays problematize the Cartesian framework that has long separated the mind from the body, reason from feeling and the human from the animal. In doing so, they consider how the sensorium can operate, variously, as a tool of power or as a means of countering the exercise of regulatory force. The senses, it is argued, operate as a vector for the implication of subjects in legal webs, but also as a powerful site of resistance to legal definition and determination. From the sensorium of animals to technologically mediated perception, the ways in which the law senses and the ways in which senses are brought before the law invite a questioning of the categories of liberal humanism. And, as this volume demonstrates, this questioning opens up the both interesting and important possibility of imagining other sensual subjectivities.

This volume looks at the ways in which governance in the exercise of its strategies also acts as a process of production of subjects. It argues that governance is not a one-sided affair starting and ending with those who rule and govern, producing fiats, decrees, and diktats, but a productive process — one that produces subjects of governance who in turn respond to the process, and make the field of governance a contentious one. Against the backdrop of the first transition of democracy in India from its origin in a colonial polity to the first phase of its independent life after the promulgation of the Indian Constitution in 1950, this volume explores the second transition towards developmental democracy, examining the interrelations between globalisation, development and structures of governance. The volume suggests that while there is need to reflect on the governance of transition, it is important to question how democracy negotiates this transition.

Indigenous efflorescence refers to the surprising economic prosperity, demographic increase and cultural renaissance currently found amongst many Indigenous communities around the world. This book moves beyond a more familiar focus on ‘revitalisation’ to situate these developments within their broader political and economic contexts. The materials in this volume also examine the everyday practices and subjectivities of Indigenous efflorescence and how these exist in tension with ongoing colonisation of Indigenous lands, and the destabilising impacts of global neoliberal capitalism. Contributions to this volume include both research articles and shorter case studies, and are drawn from amongst the Ainu and Sami (Saami/Sámi) peoples (in Ainu Mosir in northern Japan, and Sapmi in northern Europe, respectively).
