In Islands of Truth, Daniel Clayton examines a series of encounters with the Native peoples and territory of Vancouver Island in the late eighteenth and early nineteenth centuries. Although he focuses on a particular region and period, Clayton also meditates on how representations of land and people, and studies of the past, serve and shape specific interests, and how the dawn of Native-Western contact in this part of the world might be studied 200 years later, in the light of ongoing struggles between Natives and non-Natives over land and cultural status. The Political Economy of Investment Arbitration

The Political Economy of Investment Arbitration asks how political institutions and actors in the host state of an investment contribute to the emergence of investor-state disputes. This book's overarching conclusion is that democratic institutions in host states contribute to the emergence of investor-state disputes. Phillips Williams argues that at the heart of many investor-state disputes are highly politicized distributional conflicts i...

As a wide variety of state regulations allegedly aimed at protecting public health may interfere with foreign investments, a tension exists between the public health policies of the host state and investment treaty provisions. Under most investment treaties, States have waived their sovereign immunity, and have agreed to give arbitrators a comprehensive jurisdiction over what are essentially regulatory disputes. Some scholars and practitioners have expressed concern regarding the magnitude of decision-making power allocated to investment treaty tribunals. This book contributes to the current understanding of international investment law and arbitration, addressing the fundamental question of whether public health has and/or should have any relevance in contemporary international investment law and policy.
