This is the first volume in the new Oxford International and Comparative Insolvency Law Series. The series will provide a comparative analysis of all important aspects of insolvency proceedings and domestic insolvency laws in the main economically developed and emerging countries, starting with the opening of proceedings. This volume addresses the commencement of insolvency proceedings over business debtors and the conditions in which they may arise. It explains the types of proceedings available and the participants involved. The book also analyses the effect of such action on the various players, assets and liabilities concerned. The detail and uniform nature of the treatment of topics hel...
This book provides detailed analysis of the affect of insolvency on contractual obligations and relationships in the main commercially significant jurisdictions.
This new book analyses the legal and practical issues experienced during the Lehman Brothers litigation, the largest and most complex bankruptcy proceedings in history. By examining the issues the work provides a useful reference source for future large scale and cross-border bankruptcy proceedings of multinational groups. The author team includes experts from the various jurisdictions in which Lehman Brothers was operative, many of whom were involved in the litigation. The authors set out practical solutions to the issues faced, concerning, for example, the use of existing payment and settlement systems for consent solicitation, and filing instructions and insolvency distributions. Economic...
This edited volume is based on the European Law Institute's project, The Rescue of Business in Insolvency Law, which ran from 2013 to 2016. The project sought to investigate and articulate the essential features of well-functioning procedures for the "rescue" of distressed but viable businesses. Although the focus was primarily on the design and implementation of formal procedures (that is, those provided by law), the project also required consideration of the interaction between such procedures and informal solutions to distress, given the obvious cost advantages of the latter. The ELI project was not confined exclusively to restructurings, since these are only one possible route to maximising the value of a distressed but viable business (an auction procedure, in which the business is sold on a going concern basis to a new owner, is one obvious alternative). The ELI project encompasses various aspects of both public/constitutional law and insolvency law that may have a bearing on the functionality of formal restructuring procedures.
The Restructuring Review, edited by Christopher Mallon of Skadden, Arps, Slate, Meagher & Flom LLP, seeks to help general counsel, government agencies and private practice lawyers understand the conditions prevailing in the global restructuring market with a view to the coming year, and to highlight some of the more significant legal and commercial developments and trends that are expected to be significant in the future. As tensions in the Middle East, South East Asia and Russia remain unresolved, and the political implications of Brexit and mass immigration continue to be worked out in Europe and beyond, the realisation is dawning on many that a turn in the economic cycle may be approachin...
Life is good. And Michael Howard believes he has been uniquely chosen by fate for there is a singular brightness about the world he uniquely enjoys. All he has to do is continue choosing correctly. Part anti-war novel, part love story, part coming of age adventure, this novel is yet another exploration of the "American dream."
Unlucky-in-love and long-term loner Lucy Drake can find no excuse not to join her parents on a Christmas trip to the Cornish coastal town of Tintagel, not when her father's company is sponsoring the inaugural Christmas Extravaganza. Hoping to hide an embarrassing secret and generally keep out of sight, Lucy finds herself attracted to local surfing dentist, Dan. But when his ex-girlfriend and social media starlet Elizabeth Trevellian shows up to expose all of Lucy's insecurities, Lucy will need all of the magic of Christmas to help her untangle the ensuing mess. Against a backdrop of fudge, Christmas beach parties, Brussels sprouts obsessions, reindeer rides and terrible Christmas karaoke, We'll have a Wonderful Cornish Christmas is certain to delight fans of CP Ward's Christmas debut, I'm glad I found you this Christmas, and even features a cameo from a familiar face.
The first edition of Planned Short-Term Treatment established itself as an essential guide for social work and other clinical practitioners by showing them how, by limiting the duration and scope of treatment, they can help their clients solve the problems that bring them to therapy. In this revised edition, the author maintains this focus on social work practice while integrating several new approaches. He includes a new chapter on marital and family intervention, which clinically illustrates the practice applications of such theories as One-Person Family Therapy and the Relationship Enhancement approach to marital therapy. He also incorporates the new advances in the treatment of anxiety and depression through a discussion of both cognitive therapy and interpersonal psychotherapy, and includes new sections dealing with very brief psychotherapy (one to two sessions). Planned Short-Term Treatment, Second Edition, will be both an invaluable text for social work students and a comprehensive guide for the social work practitioner and other mental health professionals.
