Turkish Secularism

  • Categories: Law

There are any number of studies on Turkish secularism. However, to date there has never been a comprehensive analysis of the constitutional protection of secularism, one that systematically covers all relevant aspects. Addressing that gap, this book presents a comprehensive and coherent analysis of the constitutional framework of this principle within the Turkish legal system. Secularism is a common fundamental principle of all three Turkish constitutions (1924, 1961, 1982). The principle has been granted an irrevocable status and has been strictly constructed within the Turkish constitutional system. Despite the guarantee of irrevocability, however, its interpretation and application have u...

The pursuit of knowledge is of necessity both a comparative and an interdisciplinary enterprise. The authors of this volume, drawn from divers areas of social studies, present a unique position on the continuum of comparative science from the pursuit of qualitative to quantitative knowledge. Taking values and attitudes separately, and in combination, and comparing them across nations and time, the works contained in this study identify a matrix of nine possible themes. And while no single article addresses all nine of the themes, taken as a whole they have covered all of them and even suggested new and interesting avenues for further research. In developing their thoughts on cross-national and cross-cultural comparisons, the comparative scientific continuum has come full circle in the contributions of the authors presented here.

Things that Make for Peace

Things that Make for Peace

In a world that increasingly sees religion as a source of violence, this book explores resources from within religious traditions that might help build peace. Drawing from the rich textual histories of Christianity and Islam, the contributors mine their faith traditions for ways of thinking and ways of being that help shift perceptions about religion, and actively contribute to the growth of peace in our troubled times. Not content with retreat into religious exclusivism, these essays are an act of sharing something held dear. In sharing, the thing offered no longer remains the possession of the one who offers, and so these essays are an act of vulnerability and trust-building. In sharing precious things together, in giving and receiving, peace becomes not only a matter of dialogue, but also shared commitments to ways of being.

It is academically eclectic, not restricted to any one particular theoretical orientation or research method. Most articles report the findings of quantitative or qualitative investigations, but some deal with methodology, theory, or applications of social science studies in the field of religion.

Freedom of Religion, Security and the Law

  • Categories: Law

This collection addresses many of the issues arising from the management of religious and cultural diversity in a multicultural society and refers to the complex relationship between the right to religious freedom and security. In recent decades, and particularly since September 2001, the right to religious freedom, which has hitherto been widely protected, has come up against a significant challenge in terms of security, or rather, in the subjectively and publicly perceived feelings of security. This book collects original theoretical, legal and comparative contributions addressing several implications for the right to freedom of religion or belief through the lens of security. It offers a ...

This book includes a collection of studies focused on engagements of religious minorities with the European Court of Human Rights (ECtHR). Beginning with an introduction of the global importance of the ECtHR as a standard setter in the protection of religious minority rights, the subsequent five chapters entail critical assessments of some of the Court’s case law dealing with religious minority claims (exploring their clarity and consistency – or lack thereof – and controversiality). In the process these texts impart a nuanced perspective on the challenges the Court faces in striking the right balance between protecting individual freedoms and respecting state rights to manage ‘natio...
