O dano social surge como categoria jurídica contemporânea relacionada à potencialidade que indivíduos e coletividade têm em causar prejuízos a interesses sociais. A lesão ao bem-estar social torna-se autônoma e é uma violação de interesse coletivo, não propriamente violação da coletividade, não atentando apenas contra interesses da personalidade, o que a diferencia substancialmente do dano moral coletivo. Ainda, o dano social tem disciplina processual própria, o microssistema processual judicial coletivo, que atribui a certos sujeitos ou órgãos os instrumentos necessários para proteger de forma repressiva ou preventiva a coletividade e seus interesses, nessa hipótese inclusa a reparação pelo dano social, sob as ópticas do Direito Material e do Direito Processual e com o intuito de o autonomizar em meio à plêiade de danos que serão desenvolvidos os contornos do dano social.
