Nicole Monleón untersucht das gegenwärtige venezolanische internationale Privat- und Zivilverfahrensrecht anhand der im Februar 1999 in Kraft getretenen Ley de Derecho Internacional Privado (LDIP). Dieses erste IPR-Gesetz löst den für das venezolanische Kollisionsrechtssystem zuvor charakteristischen Widerstreit zwischen den Prinzipien der Territorialität und Personalität der Gesetze auf. Zudem erfährt das venezolanische internationale Privat- und Zivilverfahrensrecht erstmals eine zusammenhängende und inhaltlich ausgewogene Regelung. Die Autorin wertet die Gesetzesmaterialien, Rechtsprechung und Lehre im Rahmen der Kommentierung der LDIP ausführlich aus. Die wichtigste Neuerung der LDIP ist die uneingeschränkte Einführung des Wohnsitzprinzips. Ein Schwerpunkt der Untersuchung liegt daher auf der Auslegung des kollisionsrechtlichen Wohnsitzbegriffs, der in der LDIP mit dem gewöhnlichen Aufenthalt legaldefiniert wird.
Policing Prostitution examines the complex world of commercial sex in the late Russian Empire. From the 1840s until 1917, prostitution was legally tolerated across the Russian Empire under a system known as regulation. Medical police were in charge of compiling information about registered prostitutes and ensuring that they followed the strict rules prescribed by the imperial state governing their visibility and behaviour. German-American women played many roles in the US women’s rights movement from 1848 to 1890. This book focuses on three figures—Mathilde Wendt, Mathilde Franziska Anneke, and Clara Neymann—who were simultaneously included and excluded from the nativist women’s rights movement. Accordingly, their roles and arguments differed from those of their American colleagues, such as Susan B. Anthony, Elizabeth Cady Stanton, or Lucy Stone. Moreover, German-American feminists were confronted with the opposition to the women’s rights movement in their ethnic community of German-Americans. As outsiders in the women’s rights movement they became critics; as “women of two countries” they became translators of feminist and ethnic concerns between German- Americans and the US women’s rights movement; and as messengers they could bridge the gap between American and German women in a transatlantic space. This book explores the relationship between ethnicity and gender and deepens our understanding of nineteenth-century transatlantic relationships.

O crowdfunding - financiamento coletivo - popularizou-se em diversos países, no Brasil inclusive. Dada a ausência de regulação específica, existem diversas incertezas relativas às normas jurídicas aplicáveis em lides eventualmente surgidas pela sua utilização. Nesta obra, são analisadas as diversas formas pelas quais o crowdfunding é viabilizado, através de um estudo abrangente de sua utilização principalmente nos Estados Unidos da América, país onde há o maior número de estudos sobre o tema. A partir desse exame, avalia-se a natureza jurídica das relações criadas na estrutura contratual do crowdfunding para, então, averiguar-se o regime jurídico aplicável ao financiamento coletivo no Brasil.

Vorvertragliche Informationspflichten haben sich zu einem bedeutenden Instrument des Verbraucherschutzrechts entwickelt. Kathrin Weber widmet sich der Frage, inwiefern, korrespondierend zu den ausufernden Regelungen vorvertraglicher Informationspflichten, fur den Fall einer Verletzung Sanktionen auf europaischer und nationaler Ebene existieren und im Einzelfall Anwendung finden. Die Untersuchung erfolgt am Beispiel des elektronischen Geschaftsverkehrs sowie sonstiger Fernabsatzvertrage und analysiert in vergleichender Betrachtung neben einschlagigen Richtlinien und ausgewahlten Referenzwerken (DCFR und GEK-Vorschlag) Sanktionen des nationalen Rechts. Vor dem Hintergrund eines derzeit fehlenden einheitlichen Sanktionssystems auf europaischer Ebene unterbreitet die Autorin einen eigenen Vorschlag eines europaischen Sanktionsmodells, mit welchem sich bislang bestehende Defizite und Rechtsunsicherheiten beheben lassen.
