Nach dem Zusammenbruch des Sozialismus liegen Systemvergleiche in der Luft. Seit 1989 ergeben sich für die Bürger der ehemaligen DDR konkrete Folgen aus den hierbei gewonnen Erkenntnissen. Die Studie geht für den Bereich des Zivilrechts den Problemen aber auch Chancen derartiger Systemvergleiche nach. Schwierigkeiten bereitet die Frage der Vergleichsperspektive. Die bisher verwendeten Raster wurden überwiegend in der Auseinandersetzung mit dem Nationalsozialismus gewonnen. Neben Folien wie "Unrechtsstaat" und "Totalitarismus" gilt dies für den Bereich des Zivilrechts insbesondere für die Betonung der juristischen Methode als Mittel der "Umwertung".
