EU Law Enforcement

  • Categories: Law

The existence of a structured enforcement system is an inherent feature of national legal orders and one of the core elements of State sovereignty. The very limited power to issue sanctions has often been deemed a gap in the EC legal order. Over the years, the situation has progressively changed. The Union’s institutional setting is growing in complexity and a variety of agencies has been or is expected to be endowed with law enforcement responsibilities. In addition, the so-called competence creep has led the EU to play an increasingly prominent role in several areas of EU law enforcement, including the issuing of sanctions. This book examines these developments, focusing on both the gene...

A Social History of Administrative Science in Italy

This book traces the origins, life and death of Administrative Science in Italy as an academic discipline between the nineteenth and twentieth centuries. It does so by combining the study of ideas, institutional history, intellectual history and social history. The Faculty of Law first introduced Administrative Science in 1875, with the aim of providing the elite with the necessary tools to distribute wealth more equally, to take care of the population and, thus, to make the young Italian State more legitimate in the eyes of the emerging masses. Law and social sciences were merged with the aim of increasing reforms, including that of creating a State of Happiness for all citizens. Throughout its 70-year existence, Administrative Science was deprived of its contents and scientific independence, and academically overshadowed by Administrative and Public law. Finally, although the liberal elites discarded the reformer project of Administrative Science even before Fascism turned everything upside down, most of the original traits of this knowledge were absorbed into Fascist corporate and totalitarian structures.

This collection presents a comparative analysis of the principle of effective legal protection in administrative law in Europe. The book is divided into three parts: the first comprises a theoretical introductory chapter along with perspectives from International and European Law; part two presents 15 individual country reports on the principle of effective legal protection in mostly EU member states. The core function of the reports is to provide an analysis of the domestic instruments and procedures. Adopting a contextual approach, they consider the historical, political and ...

Waging War and Making Peace

The history of Europe is marked not only by violence and division but also by efforts to reduce the destructiveness of war. In this volume, the authors explore the meaning of ‘Europe’ within war and peace discourses from the eighteenth to the twentieth centuries. They examine imagined wars, the post-1815 security order, the portrayal of Russian and Muslim 'Others,' double standards in international law, pacifist rhetoric, and the role of ‘Europe’ in war propaganda and resistance movements. The authors demonstrate how both war and peace practices have shaped the concept of ‘Europe’ over time.

Energy Transitions and the Future of Gas in the EU

This book assesses the impact of energy transitions on the future of natural gas in the EU energy mix. As we approach 2050, the requirement to sharply decrease CO2 and other GHG emissions means that the role of gas infrastructure in the EU and beyond will change drastically. But what does such change mean? To address this question the author critically analyses the EU’s evolving natural gas market policy and law. Clearly structured throughout, the book explores the following questions: How can we maximise the potential of gas infrastructure to reduce carbon emissions? What are the lessons learned from decision making experience in the natural gas sector? Is the EU moving towards or away fr...
