International trade policy, including the trade policies of the European Union (EU), has become controversial in recent years. This book illuminates the politicised process of the EU’s contemporary trade negotiations. The book uses the notion of ‘contentious market regulation’ to examine contemporary EU Free-Trade Agreements (FTAs) with industrialised countries: the Transatlantic Trade and Investment Partnership with the USA (TTIP), the Comprehensive Economic and Trade Agreement with Canada (CETA), the EU-South Korea Agreement (KOREU), and the EU’s agreement with Japan (EU-Japan). It also analyses cross-cutting issues affecting trade policy, such as business dimensions, social mobilisation, parliamentary assertion, and investment. This book was originally published as a special issue of the Journal of European Integration.
This book offers the first thorough legal analysis of the practice of mixity since the Lisbon Treaty, providing the perspectives of international, EU, and national law. It sets out a detailed theoretical understanding of mixity, the common commercial policy, and the recent case law of the EU Court of Justice. It assesses recent practice and current challenges, such as the non-ratification of mixed agreements, ensuring parliamentary participation in EU treaty-making, the new architecture for concluding EU trade and investment agreements, as well as the new trade agreement between the EU and the UK post-Brexit. In so doing, the author argues that in the field of trade and investment, mixity is no longer a procedural technique to overcome legal uncertainties about competence allocations between the EU and the Member States. Instead, mixity has become a deliberate substantive design choice. This brings a fresh and innovative perspective to a key tenet of EU external relations law.
“Rich with cutting-edge insights into the complex intersections between globalization and EU trade policy, this book helps us see how the EU leverages - but also wrestles with - the new generation of trade agreements to advance its ambitions in an ever challenging global environment.” Francesco Duina, Charles A. Dana Professor of Sociology and European Studies, and Chair of the Social Sciences Division at Bates College. “Trade policy is currently at a crossroads and EU leadership at the global level is arguably more important now than ever. This book tackles the challenges ahead via insightful, multidisciplinary analysis by top scholars working at the intersection of trade and globalization.” Michael G. Plummer, Director, SAIS Europe and Eni Professor of International Economics, Johns Hopkins University.
This book provides the first analysis of the EU-UK Trade and Cooperation Agreement (TCA), which was established to ensure mutual respect and preferential trading relationships between the UK (as a non-Member State) and the European Union. In addition to offering a clear and comprehensible overview of the legal and institutional framework under international, European and UK law, it gives detailed guidance to trade in specific sectors. These include: trade in goods, services and capital; digital trade; energy; fisheries; and investment. It also examines broader themes such as sustainability; health security; cybersecurity; and dispute resolution. This is an invaluable tool for all commercial lawyers working on international trade in the EU and in the United Kingdom.
EU law has developed a unique and complex system under which the Union and its Member States can both act under international law, separately, jointly or in parallel. International law was not set up to deal with such complex and hybrid arrangements, which raise questions under both international and EU law. This book assesses how EU law has been adapted to cope with the constraints of international law in situations in which the EU and its Member States act jointly in relations with other States and international organisations. In an innovative scholarly approach, reflecting this duality, each chapter is jointly written by a team of two authors. The various contributions offer new insights into the tension that continues to exist between EU and international law obligations in relation to the (joint) participation of the EU and its Member States in international agreements.
