New Features in Contract Law

  • Categories: Law

Economic change, globalisation and harmonisation of European Law have brought new challenges to contract law. The contributions in this Volume by prominent legal scholars deal with current trends and perspectives in European and International Contract Law and their impact on the various domestic legal systems. The Compendium provides an analysis of new developments in formation of contract, performance and remedies, consumer contract law and the particularly controversial area of anti-discrimination law. The Oratorian priest Antonio Gallonio (1556-1605) devoted his life to writing about saints. The thread running through his hagiographical oeuvre was renunciation of this world: humility, subservience and endurance. Yet he engaged with the expertise of lay people, jurists, physicians and engineers, so as to appeal to their interests and convert them. In order to emphasize how saints endured torture, healed disease and exercised piety rather than ingenuity, Gallonio ventured into those secular disciplines, even if he did not endorse them. This book surveys Gallonio’s published and unpublished works and his position in Roman society, to expose the tensions between a theocratic clergy and the self-assertion of skilled and scholarly professionals in the Italian Counter-Reformation.

From Rome to Beijing: Sacred Spaces in Dialogue, edited by Daniel M. Greenberg and Mari Yoko Hara, explores the relationship between Jesuit enterprise and Ming-Qing China in the seventeenth and eighteenth centuries. The Jesuit order’s global corporation grew increasingly influential within the Chinese court after 1582, in no small part due to the two institutions shared interests in artistic and scientific matters. The paintings, astronomical instruments, spiritual texts and sacred buildings engendered through this encounter tell fascinating stories of cross-cultural communication and miscommunication. This volume approaches early modern East-West exchange as a site of cultural (rather than commercial) negotiations, where two sets of traditions and values intersected and diverged.

Visualizing Sensuous Suffering and Affective Pain in Early Modern Europe and the Spanish Americas is a trans-cultural collection of studies on visual treatments of the phenomena of suffering and pain in early modern culture. Ranging geographically from Italy, Spain, and the Low Countries to Chile, Mexico, and the Philippines and chronologically from the fourteenth to the eighteenth centuries, these studies variously consider pain and suffering as somatic, emotional, and psychological experiences. From examination of bodies shown victimized by brutal public torture to the sublimation of physical suffering conveyed through the incised lines of Counter-Reformation engravings, the authors consider depictions of pain and suffering as conduits to the divine or as guides to social behaviour; indeed, often the two functions overlap.
