Mit der ISU-Entscheidung hat das EuG bekraftigt, dass ein staatliches Gericht in seiner Entscheidung uber eine auf das Kartellrecht der Union gestutzte und gegen einen internationalen Sportverband gerichtete Schadensersatzklage in dieser Sache nicht an vorherige Entscheidungen des CAS gebunden ist. Das Zusammenspiel des verbandsseitig vorgegebenen Rechtswegs mit der Durchsetzung der Verbandsregeln wirkt auf den Markten des Sports und wirft insoweit zwangslaufig kartellrechtliche Fragen auf. Die Vorgabe des Rechtswegs zum CAS ist wohl per se mit den kartellrechtlichen Anforderungen vereinbar. Gregor Opfermann beleuchtet, ob sich Verknupfungen mit der kartellrechtlichen Bewertung der Sportverbandsregeln zeigen, die eine baldige Reform des CAS-Codes verlangen.
A Companion to Boniface
The eighth-century English missionary and church reformer Boniface was a highly influential figure in early medieval Europe. His career in what is now Germany, France, and the Netherlands is attested in an exceptional number of textual sources: a correspondence of 150 letters, Latin poetry, church council records, and other documents. Numerous saints’ lives and modern devotional materials further reveal how he was and is remembered by the religious communities that claim him as a foundational figure. This volume comprises the latest scholarship on Boniface and his fellow missionaries, examining the written materials associated with Boniface, his impacts on the regions of Europe where he worked (Hessia, Thuringia, Bavaria, Frisia, and Francia), and the development of his cult in the Middle Ages and today. Dismantling the Dream Factory
The history of postwar German cinema has most often been told as a story of failure, a failure paradoxically epitomized by the remarkable popularity of film throughout the late 1940s and 1950s. Through the analysis of 10 representative films, Hester Baer reassesses this period, looking in particular at how the attempt to 'dismantle the dream factory' of Nazi entertainment cinema resulted in a new cinematic language which developed as a result of the changing audience demographic. In an era when female viewers comprised 70 per cent of cinema audiences a 'women's cinema' emerged, which sought to appeal to female spectators through its genres, star choices, stories and formal conventions. In addition to analyzing the formal language and narrative content of these films, Baer uses a wide array of other sources to reconstruct the original context of their reception, including promotional and publicity materials, film programs, censorship documents, reviews and spreads in fan magazines. This book presents a new take on an essential period, which saw the rebirth of German cinema after its thorough delegitimization under the Nazi regime.
