In Germany, as elsewhere, couples and individuals suffering from unwanted childlessness have two principal means to overcome it. One, adoption, has existed and has been quite heavily regulated in Germany for centuries. The other, assisted reproduction, has only recently come into its own with advances in medical technology and has not yet been comprehensively dealt with by the German legislature. Freedom of testation allows an individual to make effective on his death dispositions of his property on the event of his death. Dependants' relief legislation in British Columbia and compulsory portion in Germany limit this freedom by providing testator's family members with a portion of the estate. However, out of the two, only the legislation gives courts the discretion to change testamentary provisions, by making them, in some cases, entirely ineffective. A comparative analysis of the application, legal character, history and purpose of the limitations leads to the conclusion that the freedom of testation is significantly more limited under British Columbia's legislation than it is under the German law. The author proposes a solution that increases the freedom, adds predictability and reduces subjectivity of the application of the dependants' relief legislation in British Columbia.

Die gerichtliche Kontrolle von Pflichtteilsverzichtsverträgen erfordert dogmatisch und methodisch fundierte Maßstäbe, die ihren Ausgangspunkt im Normzweck des Pflichtteilsrechts finden. Der Autor stellt dabei den Schutz des Pflichtteilsberechtigten in den Mittelpunkt seiner Arbeit. Er erklärt das Pflichtteilsrecht des Ehegatten und Kindes teleologisch mit dem Prinzip der Vertrauenshaftung und erkennt in ihm insbesondere den Zweck des Ausgleichs ehe- und familienbedingter Nachteile. Hierdurch verleiht er der Förderung familiärer Solidarität und dem Schutz der Familie, die dem Pflichtteilsrecht durch das BVerfG als Normzwecke zugemessen wurden, dogmatische Konturen, die für die Ausformung gerichtlicher Kontrollmaßstäbe fruchtbar gemacht werden können. Auf dieser Grundlage tritt er für eine Harmonisierung mit den Kontrollmaßstäben ein, die nach dem BGH auf Eheverträge Anwendung finden. Er plädiert für eine gerichtliche Kontrolle zur Gewährleistung prozeduraler und materialer Vertragsgerechtigkeit, die für die Zeit des Vertragsschlusses (Wirksamkeitskontrolle) und für die Zeit der gelebten Vertragspraxis nach Vertragsschluss (Ausübungskontrolle) durchzusetzen sind.
