Das deutsch-türkische Forum für Staatsrechtslehre dient der Förderung des wissenschaftlichen Austausches zwischen deutscher und türkischer Staatsrechtslehre. Die vorliegend dokumentierte Tagung hatte die Ausgestaltung der Gewaltenteilung in der Demokratie zum Gegenstand. Dabei ging es nicht zuletzt um die Frage, ob Erfahrungen aus den parlamentarischen und präsidentiellen Regierungssystemen des Westens für die Verfassungsreform nutzbar gemacht werden können, die in der Türkei derzeit vorbereitet wird.

Anayasa Mahkemesinin Anayasaya uygunluk denetimi sonucunda vermiş olduğu iptal kararlarının geriye yürümeyeceğine ilişkin, gerek 1961 Anayasasının 152. maddesinin üçüncü fıkrasında, gerekse 1982 Anayasasının 153. maddesinin beşinci fıkrasında yer alan kural; iptal kararı sonrasında ortaya çıkan yasal boşluğun nasıl ve hangi zaman diliminde doldurulacağı, bu süreçte hangi kuralın uygulanacağı, kişiler açısından hukuki güvenliğin nasıl tesis edileceği, içtimai huzur mülâhazasıyla ortaya çıkan uygulamanın kazanılmış haklara nasıl etki edeceği, diğer taraftan çeşitli davalarda dava türüne ve uygulanan hükme göre iptal kararının nasıl etki doğuracağı yolundaki sorularla geçmişte olduğu gibi bugün de uygulamada birtakım sorunlara yol açmaktadır.
