This is an open access book.Welcome to the 2-nd AISYIYAH International Conference on Health Sciences and Medicine (A-HMS). This conference is part of the 3-rd International Conference of Health, Science and Technology Organized by Universitas ‘AISYIYAH Yogyakarta. Theme of the conference is Transformation of Technology for a Better Life. This conference is designed to provide a forum for experts from various disciplines to contribute their expertise and experience related to technological transformation for a better life that can be seen from the dimension of health and medical science. The conference will be held on October 14-15, 2022.
TEORI HUKUM
Hukum pada dirinya sendiri tidak pernah merupakan suatu tujuan, melainkan suatu sarana untuk mencapai suatu tujuan non-yuridikal. Finalitas dari hukum itu tidak yuridikal dan hukum karena itu memperoleh dorongan pertumbuhannya (groei stimulus) dari luar hukum. Faktor- faktor ekstra-yuridika; memelihara proses pertumbuhan dinamikal berlangsung terus (Jan Gijssels, Mark Van Hoecke, 2001: 13). Oleh sebab itu, pendekatan interdisipliner akan membantu menemukan dan menjelaskan keterkaitan hukum dan masyarakat. Dengan demikian akan lahir para sarjana hukum profesional yang tidak hanya paham tentang ilmu hukum, tetapi juga insan hukum yang dapat berfungsi maksimal karena paham tentang sendi-sendi keadilan masyarakatnya sendiri. Dalam konteks ini relevan paparan Bambang Poernomo (1993: 13) mengenai hukum sebagai sistem aksi yang bersifat dinamis dengan memperhatikan pertimbangan-pertimbangan faktor-faktor nonyuridis dari fungsi asas kemasyarakatan, asas sosial politik ekonomi, dan berbagai fenomemena yang hidup dalam masyarakat.
