A Constituição Federal de 1988 trouxe ao Poder Judiciário uma nova ideia de justiça, a qual está sendo moldada e reestruturada com a elaboração de novas leis. O objetivo do presente trabalho é fazer uma abordagem acerca do art. 285-A, inserido ao Código de Processo Civil por meio da Lei 11.277, de 7 de fevereiro de 2006, que faz parte da reforma do poder judiciário. A ideia de prolação de sentença de mérito sem a citação da parte adversa trouxe grandes discussões ao sistema processual, tanto no que diz respeito a sua aplicação e interpretação literal do artigo, quanto a constitucionalidade da norma. A revisão bibliográfica permitiu apresentar ideias de diversos doutrinadores, trazendo também como material para análise, a própria ação que discute a constitucionalidade da improcedência liminar.
