EU Law Beyond EU Borders

This book addresses the impact of EU law beyond its own borders, the use of law as a powerful instrument of EU external action, and some of the normative challenges this poses. The phenomenon of EU law operating beyond its borders, which may be termed its 'global reach', includes the extraterritorial application of EU law, territorial extension, and the so-called 'Brussels Effect' resulting from unilateral legislative and regulatory action, but also includes the impact of the EU's bilateral relationships, and its engagement with multilateral fora and the negotiation of international legal instruments. The book maps this phenomenon across a range of policy fields, including the environment, the internet and data protection, banking and financial markets, competition policy, and migration. It argues that in looking beyond the undoubtedly important instrumental function of law we can start to identify the ways in which law shapes the EU's external identity and its relations with other legal regimes, both enabling and constraining the EU's external action.

Data at the Boundaries of European Law

  • Categories: Law

Data at the Boundaries of European Law represents an original and engaged piece of scholarship in an important and fast developing field of policy and research. Beyond, and including, the most recent major new pieces of EU legislation-the Data Governance Act, together with the Data Act and the AI Act still going through the legislative process-this book draws attention to the substance of a number of core themes of the relationship between law and the digital world that are still somewhat hidden. These themes include the mimetic regulatory trajectories in and around the GDPR, transparency, ownership, and accountability, as well as the translation of all of these into core areas of public law...

The European Convention of Human Rights Regime

  • Categories: Law

Prompted by an unprecedented rise of litigation since the 1990s, this book examines how the European Convention of Human Rights (ECHR) system and the Strasbourg Court interact with states and non-governmental actors to influence domestic change. Focusing on European Court of Human Rights litigation and state implementation of judgments related to minority discrimination and asylum/migration, it argues that a fundamental transformation of the Convention system has been under way. Repeat and strategic litigation, shifting methods of supervision and state implementation to remedy systemic violations, and above all the growing engagement of civil society and non-governmental actors, have prompte...

The A to Z of the European Union

Over half a century old and continuing to grow in strength and authority, the European Union consists of 25 member states_with more on the waiting list_and a population of 450 million people. Its influence in foreign and domestic affairs and human rights and law reaches far beyond its earlier fields of trade and politics. From the initial ideas about integration leading to the Treaty of Paris and the creation of the European Coal and Steel Community to the current reflection on the Treaty establishing a Constitution for Europe, The A to Z of the European Union encompasses the most basic elements of the EU and the components that have emerged as a result of them. Through the use of maps, photographs, a chronology, an introductory essay, a bibliography, and hundreds of cross-referenced dictionary entries on topics such as leaders, personalities, institutions, enlargements, member states, internal policies, external relations, basic theories, treaties, and law, this dictionary tells a clear and complete story about the European Union that will assist those with greater interest in understanding it.

This excellent volume examines the legal implications of introducing environmental taxes and other economic instruments into the regulatory framework of UK law.
