What this book intends to do is to study three-dimensionalism (the distinction values-norms-facts) not in what could be called its historical dimension, but in its substantive aspect, as a “form” that, when applied to different legal themes, would add a “material content” to the three-dimensional theory. We can point out, as a study plan, the distinction between “three” perspectives: Those of the legal norm, of the legal order, and the legal relationship. Three-dimensionalism also appears in this work when one analyzes the “three” phases of the life of the law: The formation, the interpretation, and the application; and in the distinction between the “three” characteristics of the legal order: Fullness, coherence, and unity—the theory of legal validity, intended as legitimacy, as validity strictly speaking, or as effectiveness.
New Conversations in Philosophy, Law, and Politics offers a new agenda for work where these three disciplines meet. It showcases three generations of scholars—from newly minted professors to some of today's most distinguished thinkers. Consisting of fifteen conversations, pairs of chapters dedicated to a single topic, the volume provides intergenerational and multidisciplinary perspectives on aspects of our social world. Each conversation comprises a first paper by a scholar who sets the topic, followed by a second paper by a scholar of a different generation, and usually a different discipline, who offers further insight or commentary. Each conversation thus provides two sets of original thoughts about a matter of lively current interest and interdisciplinary significance. Topics investigated include moral revolutions, AI and democracy, trust and the rule of law, responsibility, praise and blame, reasonableness, duty, political obligation, justice and equality, justice and intersectionality, domination, pornography, intentions in the law, and legal argumentation. This book presents the theory of the validity of legal norms, aimed at the practice of law, in particular the jurisdiction of the constitutional courts. The postpositivist concept of the validity of statutory law, grounded on a critical analysis of the basic theories of legal validity elaborated up to now, is introduced. In the first part of the book a contemporary German nonpositivist conception of law developed by Ralf Dreier and Robert Alexy is analysed in order to answer the question whether the juristic concept of legal validity should include moral standards or criteria. In the second part, a postpositivist concept of legal validity and an innovative model of validity discourse, based on the juristic presumption of the validity of legal norms, are proposed. The book is a work on analytical legal theory, written from a postpositivist, detached point of view.

Este libro es el resultado del diálogo entre civilistas y filósofos del Derecho en torno a algunos conceptos multidimensionales, cláusulas generales o conceptos válvula, por mencionar solo alguna de las expresiones utilizadas para referirse a términos utilizados en las normas jurídicas cuya dosis de vaguedad, indeterminación o generalidad impiden considerar cerrado a priori el ámbito de aplicación de aquellas. Se trata de tres de los más utilizados por los especialistas en Derecho privado: los dos primeros, el “orden público” y la “buena fe”; el tercero pretende abarcar el conjunto de expresiones que el legislador viene usando desde tiempo inmemorial para hacer referencia al deber de diligencia que puede o debe resultar exigible en determinadas relaciones inter privados, como son las de“buen padre de familia”, “persona razonable”, “lex artis”, y otras de similar papel.
