National Courts and EU Law

  • Categories: Law

National Courts and EU Law examines both how and why national courts and judges are involved in the process of legal integration within the European Union. As well as reviewing conventional thinking, the book presents new legal and empirical insights into the issue of judicial behaviour in this process. Judicial Cooperation in European Private Law

  • Categories: Law

Notwithstanding recent increases in the scope for judicial cooperation and dialogue between European courts, little research has been undertaken into the impact of the jurisprudence of the European Court of Justice, and the dialogue that arises therefrom, in national legal systems between courts and regulators. This coherent collection of original chapters provides unique insights into these developments – with a particular focus on consumer law – from a broad range of stakeholders, including academics and judges from the EU and the US.

Singing on the River by Igor Chabrowski, based on Sichuan boatmen’s work songs (haozi), explores the little known world of mentality and self-representation of Chinese workers from the late 19th century until the outbreak of the Second Sino-Japanese War (1937). Chabrowski demonstrates how river workers constructed and interpreted their world, work, and gender in context of the dissolving social, cultural, and political orders. Boatmen asserted their own values, bemoaned exploitation, and imagined their sexuality largely in order to cope with their low social status. Through studying the Sichuan boatmen we gain an insight into the ways in which twentieth-century nonindustrial Chinese workers imagined their place in the society and appropriated, without challenging them, the traditional values.

The ever-increasing use of technology is challenging the current status of the law, bringing about new problems and questions. The book addresses this trend from the perspective of International law and European Union law and is divided into three main thematic sections. The first section focuses on the legal implications of the use of technology either for law enforcement purposes or in the context of military activities, and examines how this use adds a new dimension to perennial issues, such as the uneasy balance between security concerns and the protection of individual rights, and defining the exact scope of certain State obligations. In so doing, it takes into account a range of curren...

Circular Migration and the Rights of Migrant Workers in Central and Eastern Europe

This open access book adopts a rights-based approach to shed light on the different legal and policy instruments that have been developed to implement circular migration policies in the EU, and their consequences for the rights of migrant workers. It contributes to the understanding of the meaning of this concept in general and in the EU, as well as specifically regarding its Eastern neighborhood. The book provides a comprehensive picture of the formation and implementation of the EU’s circular migration approach that has developed through both EU and national instruments, on the basis of comparative case study analysis of Bulgaria and Poland’s migration laws and policies.
