The regulation on defects of consent loses its usefulness and should be replaced by special regulations, more suited to the requirements of consumer e-commerce. The study’s main objective is to verify whether, due to the evolution of the concept of the declaration of intent, the emergence of non-individual consumer protection instruments, and technological developments the code regulation of defects in the declaration of will remains useful in the case of contracts concluded by consumers on the Internet. The impact of the development of the Internet environment on the applicability and effectiveness of this traditional private institution is analyzed. Mechanisms that, in practice, displace the regulation of vice of consent are indicated.

Routledge Handbook of Private Law and Sustainability

  • Categories: Law

The Routledge Handbook of Private Law and Sustainability reflects on how the law can help tackle the current environmental challenges and make our societies more resilient to future crises. Sustainability has been high on the political agenda since the approval of the Sustainable Development Goals in 2015 and the EU Green Deal in 2019. The Green Agenda aims at making Europe the first climate‐neutral continent by 2050, but humanity persists in an ecological overshoot that puts at risk the survival of species, including that of our own. Drawing together a selection of leading thinkers in the field, this Handbook provides a curated overview of the most recent and relevant discussions for priv...

The contributions focus on succession and obligation law norms shaping the legal status of an heir and their comparison within Polish and German law systems. They analyse the impact of the instruments of contract law on the status of an heir. The adopted methodology combining the internal-national and external-comparative perspective allows the authors to present “similarities in dissimilarities” within institutions of the German and Polish succession law. The broad analyses of legal doctrine and jurisprudence can serve as a source of knowledge and points of reference for legal practitioners, courts and legislators.

Legal Challenges in the New Digital Age addresses a wide range of legal issues related to emerging technologies. These technologies pose prominent legal challenges, in particular, how to wedge new phenomena into old frameworks; whether we can and should delegate responsibilities to technologies and how to cope with newly created powers of manipulation. Edited by Ana Mercedes Lopez Rodriguez, Michael D. Green and Maria Lubomira Kubica, the book’s sixteen chapters are written by highly qualified international practitioners and academics from different jurisdictions. Familiarity with the intricacies of emerging technologies is essential for judges, practitioners, legal staff, business people and scholars. One of the aims behind issuing a new directive on consumer sales contracts (directive 2019/771) was to adjust this part of contract law so that it can contribute to sustainable development. The Rec. 32 of the directive explicitly states that one of its objectives is to achieve more sustainable consumption patterns and a circular economy. This article analyses whether and to what extent this motive is reflected in the black letter rules of the directive (the previous directive on consumer sales contracts constitutes a point of reference). The work begins with a general assessment of the interplay between the values the directive is meant to protect. The impact that the values at hand may have...
