The subject-matter of this book is the transfer of movable property in German, French, English and Dutch law. Of particular importance is the division into the three main types of transfer system: the causal consensual system, the causal tradition system and the abstract tradition system. Here two dividing lines intertwine: the distinction between causal and abstract systems and the distinction between consensual and tradition systems. Die Verfasser des BGB führten zwei Rechtsfiguren ein, das Abstraktionsprinzip und den gutgläubigen Erwerb, die demselben Zweck dienen, nämlich dem Verkehrsschutz. Wahrscheinlich fiel ihnen diese Zwecküberschneidung nicht auf. Tatsache ist, dass viele Autoren aufgrund dieser Duplizität vertreten, das Abstraktionsprinzip sei für das deutsche Recht überflüssig, denn seine vorteilhaften Rechtsfolgen, insbesondere den Schutz des gutgläubigen Dritterwerbers, führe schon der redliche Erwerb herbei; und seine übrigen Rechtsfolgen seien aus rechtsethischer Sicht schwer zu rechtfertigen. Dieses Buch versucht, mit Hilfe der Rechtsgeschichte und des Rechtsvergleiches, die Folgen des Zusammenwirkens dieser beiden Rechtsfiguren darzustellen.

Thomas Richter untersucht die Zulassigkeit und Reichweite der Rechtswahl im Immaterialguterrecht de lege lata und de lege ferenda. Dabei geht er insbesondere auf die Bedeutung der Rechtswahl fur das dingliche Verfugungsgeschaft beziehungsweise die Abgrenzung zwischen Vertragsstatut und dinglichem Statut sowie die Zulassigkeit einer Rechtswahl bei der Verletzung von Immaterialguterrechten ein. Die Untersuchung erfolgt rechtsvergleichend anhand der bestehenden Kollisionsregeln in der EU, den USA und der Schweiz und bezieht die Losungsansatze von Modellgesetzen mit ein. Abschliessend entwickelt Thomas Richter auf Grundlage der kollisionsrechtlichen Dogmatik neue Regeln unter Berucksichtigung des Interesses der Parteien an Rechtssicherheit und niedrigen Transaktionskosten sowie marktordnungsrechtlicher Erfordernisse im Bereich der Immaterialguter.
