Es beruht auf der EU-Emissionshandelsrichtlinie, delegiert aber wesentliche Entscheidungen an die Mitgliedstaaten. Die Autorin analysiert die grundrechtlichen Vorgaben für nationale Gesetzgeber bei der Entscheidung über die Zu- und Aufteilung der Zertifikate mit dem Ziel, allgemeingültige Grundsätze zu entwickeln.
