In der juristischen Literatur wird der Begriff der "Pfadabhangigkeit" zumeist metaphorisch verwendet. Anders ist dies in den benachbarten Gesellschaftswissenschaften, wo das gleichnamige Konzept der Erklarung insbesondere institutioneller Entwicklungsprozesse dient. Nico Schrter geht der Frage nach, ob und wie eine Rezeption dieses Konzepts auch fur die Rechtswissenschaft erkenntnisversprechend ist. Dabei kann eine (informierte) Rezeption insbesondere dazu dienen, informelle Strukturbildungsprozesse im Recht besser zu verstehen. So bietet Pfadabhangigkeit eine plausible Erklarung fur die relative Stabilitat judikativer Entscheidungsstandards und rechtsdogmatischer Satze sowie - in Ansatzen - auch dafur, inwieweit diese einem Wandel unterliegen. Die Rezeption des Pfadabh?ngigkeitskonzepts liefert daher eine Antwort auf bestehende Theoriedefizite bei der Erklarung rechtlicher Phanomene.
