De ahí la conveniencia de explorar dentro de nuestro sistema jurídico las normas y principios generales de los con-tratos que confluyen en este escenario, a veces de manera pacífica y otras con ciertas tensiones, para responder a esas inquietudes y, tal vez, ¿por qué no?, precaver litigios innecesarios.
El presente trabajo de investigación tiene por objeto analizar de manera crítica dentro del ámbito del derecho internacional público los aspectos controvertidos que plantean los Acuerdos Internacionales de Inversión, haciendo especial énfasis en la relación Estado-inversores. Cabe destacar que, a pesar de la existencia de dualidad entre partidarios y detractores de este tipo de tratados internacionales, esta investigación no busca detenerse en ello, sino que centra su estudio en las garantías y estándares pactados en relación con la promoción y protección de la inversión extranjera y en la conveniencia o no de las mismas para los estados de la región latinoamericana realizando especial referencia a Colombia.
