Fundamental legal problems of surrogate motherhood. Global perspective.

  • Categories: Law

The observation that mater semper certa est remains accurate under most legal systems in the world. Maternity is defined as the personal status (filiation) of a woman who gave birth to a child. It is typically complemented by the fatherhood of the man from whom the child biologically originates (often quem nuptiae demonstrant). However, in some states, a kind of competitive way of acquiring the legal status of mother and father (or “homosexual parents A and B”) has been introduced via concluding a contract with a surrogate mother. Usually with a woman coming from poorer societies and with the assistance of professional intermediaries and organizers. The postulates to change substantive f...

This book explores the notion of neighbourly law. In the twentieth century, some German church law scholars viewed neighbour law as the foundational principle of the church law system. However, this perspective has since evolved. Around the year 2000, there was a growing focus in the Anglo-Saxon world on the relationship between love and law. Although neighbour law can no longer be regarded as the sole foundation of church law, the obligation remains to reflect critically on the role of the neighbour in legal theological discourse, the development and codification of church law, and its practical application. Canon law is a diaconal ordering of God’s love, or neighbour law.

This book is aimed at analyzing the foundations of medical ethics by considering different moral theories and their implications for judgments in clinical practice and policy-making. It provides a review of the major types of ethical theory that can be applied to medical and bioethical issues concerning reproductive genetics. In response to the debate on the most adequate ethical doctrine to guide biomedical decisions, this book formulates views that capture the best elements in each, bearing in mind their differences and taking into account the specific character of medicine. No historically influential position in ethics is by itself adequate to be applied to reproductive decisions. Thus, ...

The Subject of Copyright

  • Categories: Law

Exploring the concept of copyright subject matter through the lenses of law, aesthetics, and cognitive science, this book describes the historical evolution of a work into an artefact that qualifies as copyrightable subject matter. Discussing the originality requirement towards an artefactual understating of intangible goods, copyright’s present struggles with modern societies and technologies, and growing inequalities between rights holders and producers, the book adopts an interdisciplinary approach based on studies in law, aesthetics, neuroscience, and cognitive science to present a novel perspective on the non-artefactual and contextual identification of copyright subject matter. The b...
