Der Erbschaftskauf - ein überflüssigerweise normiertes Rechtsinstitut?
Der Erbschaftskauf ist im BGB gesondert geregelt. In der Praxis spielt er keine große Rolle. Allein dies wirft die Frage auf, ob es überhaupt Spezialnormen zum Erbschaftskauf bedarf. Die Schuldrechtsreform hat das allgemeine Kaufrecht so geändert, dass der Sinn der Sonderregelung für das besondere Objekt Erbschaft noch zweifelhafter wurde. Nach § 453 BGB n. F. gelten die Vorschriften über den Kauf von Sachen auch für sonstige Gegenstände. § 453 BGB n. F. erfasst damit neben dem Erbschaftskauf alle möglichen Objekte, und für das mindestens ebenso komplexe, aber wirtschaftlich weitaus bedeutendere Unternehmen gibt es keine Spezialregeln. Die Arbeit untersucht, inwieweit im geltenden Recht eine Vereinfachung der Normen über den Erbschaftskauf möglich ist.
