Introducing the Negev–Bedouin land issue from the international indigenous land rights perspective, this comparative study suggests options for the recognition of their land. The book demonstrates that the Bedouin land dispossession, like many indigenous peoples’, progressed through several phases that included eviction and displacement, legislation, and judicial decisions that support acts of dispossession and deny the Bedouin’s traditional land rights. Examining the Mawat legal doctrine on which the State and the Court rely on to deny Bedouin land rights, this volume introduces the relevant international law protecting indigenous land rights and shows how the limitations of this law ...

Israel's Palestinians

Arguing that a comprehensive and lasting solution to the Israeli-Palestinian conflict depends on a resolution of the Jewish-Palestinian conflict within Israel as much as it does on resolving the conflict between Israel and Palestinians in the Occupied Territories, this timely book explores the causes and consequences of the growing conflict between Israel's Jewish majority and its Palestinian-Arab minority. It warns that if Jewish-Arab relations in Israel continue to deteriorate, this will pose a serious threat to the stability of Israel, to the quality of Israeli democracy, and to the potential for peace in the Middle East. The book examines the views and attitudes of both the Palestinian minority and the Jewish majority, as well as the Israeli state's historic approach to its Arab citizens. Drawing upon the experience of other states with national minorities, the authors put forward specific proposals for safeguarding and enhancing the rights of the Palestinian minority while maintaining the country's Jewish identity.

Indigenous peoples are increasingly making requests for the return of their ancestors’ human remains and ancient indigenous deoxyribonucleic acid. However, some museums and scientists have refused to repatriate indigenous human remains or have initiated protracted delays. There are successful examples of the return of ancient indigenous human remains however the focus of this book is an examination of the "hard" cases. The continued retention perpetuates cultural harm and is a continuing violation of the rights of indigenous peoples. Therefore this book develops a litigation Toolkit which can be used in such disputes and includes legal and quasi legal instruments from the following frameworks, cultural property, cultural heritage, cultural rights, collective heritage, intellectual property, Traditional Knowledge and human rights. The book draws on a process of recharacterisation. Recharacterisation is to be understood to mean the allocation of an indigenous peoples understanding and character of ancient indigenous human remains and ancient indigenous DNA, in order to counter the property narrative articulated by museums and scientists in disputes.

Settler-Indigeneity in the West Bank

Since Israel conquered the West Bank, formerly held by Jordan, in 1967, over 400,000 settlers have moved into the territory. In recent years, Israeli settler organizations and allied American-Jewish lobbyists have responded to international condemnation of the occupation by mobilizing narratives of indigeneity, claiming sovereign and divine rights to the land. Settler-Indigeneity in the West Bank asks what Israeli settlers mean when they say they are indigenous; how settler indigeneity is felt, performed, and mediated; and what the implications of indigeneity claims are on the international stage. Building on foundational scholarship that has come out of post-colonial and indigeneity studies...

Examining business-state networks in Egypt (1991–2020), this book highlights the complicity of international actors in facilitating inequality and elite capture. Using interdisciplinary methodology, it argues that Western actors promoting market liberalization have served as central partners in enabling elites to capture the fruits of Egypt’s economic reforms. In the years leading up to the 2011 Revolution, Egypt’s crony capitalism reached new levels of visibility with the appointment of a "Businessmen Cabinet." The businessmen-turned-state representatives ushered in a wave of "market liberalizing" reforms, expanding avenues for the abuse of power. Providing a detailed look at some of ...
