Islamic Jihadism and the Laws of War

  • Categories: Law

The rapid rise of global Islamic Jihadism in the past few decades and the limited success of the anti-terror campaign in halting its expansion have raised hard-hitting questions about how different political actors might preserve and restore the world's peace and security. Since the end of the Second World War, international law has often been the chief instrument employed to address global conundrums of this kind. Nevertheless, international law alone cannot solve this problem. Jihadist groups often cite Islamic law argumentations to justify their combat-related actions against states while rejecting traditional international law rules. On the other hand, some states themselves ignore tradi...

Tahrir's Youth

A gripping, in-depth account of the 2011 Egyptian revolution, through the eyes of its youthful vanguard January 25, 2011, was a watershed moment for Egypt and a transformative experience for the young men and women who changed the course of their nation’s history. Tahrir’s Youth tells the story of the organized youth behind the mass uprising that brought about the spectacular collapse of the Mubarak regime. Who were these activists? What did they want? Islamic Religious Authority in a Modern Age

This book situates Australian Muslim experiences of religious authority within the global context of Islam in the modern world. While drawing on examples of Muslim-majority states, new empirical findings indicate the growing diversity of Muslim religious actors in Australia, as well as the contextual realities shaping the way religious authority is legitimised and contested in democratic and authoritarian environments. In particular, the study challenges homogenous articulations of Islamic religious authority in unearthing new voices, epistemologies and socio-political factors shaping Muslim attitudes and experiences of religious authority. The book fills important gaps in the field, such as intra-Muslim relations, female religious authority, digital Islam and the relationship between traditional ulama, reformists and Muslim intellectuals in the West. Dr Shaheen Whyte is a Research Fellow at the Centre for Islamic Studies and Civilisation, Charles Sturt University. He holds a PhD from Deakin University, Australia. His research focuses on Islamic religious authority, Muslim minorities in the West, Islamic law and Middle Eastern politics.

Kur’an’a, İslam geleneğinin unutulmuş zenginliklerine ve çağdaş akademik kaynaklara dayanarak, günümüzün yakıcı dinî meselelerine yeni bakış açıları öneriyor. Katılmasanız bile, düşünmeye davet ediyor.

Afghanistan Rising

Debunking conventional narratives of Afghanistan as a perennial war zone and the rule of law as a secular-liberal monopoly, Faiz Ahmed presents a vibrant account of the first Muslim-majority country to gain independence, codify its own laws, and ratify a constitution after the fall of the Ottoman Empire. Afghanistan Rising illustrates how turn-of-the-twentieth-century Kabul--far from being a landlocked wilderness or remote frontier--became a magnet for itinerant scholars and statesmen shuttling between Ottoman and British imperial domains. Tracing the country's longstanding but often ignored scholarly and educational ties to Baghdad, Damascus, and Istanbul as well as greater Delhi and Lahore...

Foundations of Jurisprudence: An Introduction to Imāmī Shīʿī Legal Theory is a critical edition of the Arabic text with a parallel English translation of Mabādiʾ al-wuṣūl ilā ʿilm al-uṣūl by al-ʿAllāmah al-Ḥillī, introduced, edited and translated by Sayyid Amjad H. Shah Naqavi. Al-ʿAllāmah al-Ḥillī participated in the leading debates of his day and applied his vast erudition in philosophy, logic, and theology to the paramount subject of jurisprudence. This text presents an exemplar of the rich revival of Shīʿī scholarship in the thirteenth and fourteenth centuries of the Common Era. Concise, yet comprehensive, this work sets the standard for the subsequent development and discussion of Imāmī Shīʿī legal theory, such that its influence can be traced through to modern times. This dual-text edition is indispensable for students and scholars of Imāmi Shīʿī jurisprudence.
