Peacebuilding and International Administration

This book provides a detailed historical and political analysis of the role and effectiveness of international administration in statebuilding. It analyses how the international administrations in Bosnia and Herzegovina and Kosovo have attempted to create sustainable political institutions and to what extent they have been successful in doing so. In the 1990s, large and ambitious international administrations were established to administer territories that had been left without an effective government in the wake of violent conflict. International administrations, to a greater extent than peacebuilding operations, exercise extensive authority and take over the governance of a country. Though...

EU Foreign Policy and Crisis Management Operations

This book explores the drivers of the EU’s recent forays into peace- and state-building operations. Since the Union’s European (now Common) Security and Defence Policy (ESDP/CSDP) became operational in 2003, the EU has conducted more than 20 civilian and military operations that broadly served to either deter aggression in host countries, and/or to build or strengthen the rule of law. This sudden burst of EU activity in the realm of external security is interesting from both a scholarly and a policy perspective. On one hand, institutionalised cooperation in the field of foreign, security and defence policy challenges the mainstream in IR theory which holds that in such sovereignty-sensit...

Hybrid Justice

  • Categories: Law

The last decade has seen the unexpected re-emergence of hybrid and internationalised courts - institutions which operate with varying combinations of national and international law, procedure, and staff. Whilst the establishment of the permanent International Criminal Court should have made hybrid mechanisms largely obsolete, hybrids have recently been established or proposed for atrocity crimes committed in Chad, South Sudan, Israel/Palestine, the Central African Republic, Kosovo, Syria, Sri Lanka, Myanmar, The Gambia, Liberia, and Ukraine. Hybrid Justice critically examines the resurgent promise of hybrid courts. Focusing on the fields, practices, innovations, and of hybrid courts, the con...

The Ideas and Practices of the European Union’s Structural Antidiplomacy

In The Ideas and Practices of the European Union’s Structural Antidiplomacy, Steffen Bay Rasmussen offers a comprehensive analysis of EU diplomacy that goes beyond the functioning of the European External Action Service and discusses the sui generis nature of the EU as a diplomatic actor, the forms of bilateral and multilateral representation as well as the actor identity, founding ideas and meta-practices of EU diplomacy. The book employs a novel theoretical approach that distinguishes the social structures of diplomacy from the practices and meta-practices of diplomacy. Comparing EU diplomacy to the two theoretically constructed ideal types of Westphalian diplomacy and utopian antidiplomacy, Steffen Bay Rasmussen concludes that the EU’s international agency constitutes a new form of diplomacy called structural antidiplomacy.

This book explains what ‘small’ states are and explores their current security challenges, in general terms and through specific examples. It reflects the shift from traditional security definitions emphasizing defence and armaments, to new security concerns such as economic, societal and environmental security where institutional cooperation looms larger. These complex issues, linked with traditional power relations and new types of actors, need to be tackled with due regard to democracy and good governance. Key policy challenges for small states are examined and applied in the regional case studies. The book deals mainly with the current experience and recent past of such states but al...

How does the globalization of law, the emergence of multiple and shifting venues of legal accountability, enhance or evade the fulfillment of international human rights? Alison Brysk’s edited volume aims to assess the institutional and political factors that determine the influence of the globalization of law on the realization of human rights. The globalization of law has the potential to move the international human rights regime from the generation of norms to the fulfillment of rights, through direct enforcement, reshaping state policy, granting access to civil society, and global governance of transnational forces. In this volume, an international and interdisciplinary team of scholar...
