Italian Studies in Law
"Italian Studies in Law" is a new yearbook containing a selection of studies on Italian law edited by the Italian Association of Comparative Law. Each volume includes essays on private law, public law, procedural law and other judicial disciplines that are of interest to jurists in other countries, which will allow them to form an opinion on developments in the study of law conducted in Italian legal faculties.
A Treatise of Legal Philosophy and General Jurisprudence
TO VOLUMES 9 AND 10 OF THE TREATISE I am happy to present here the third batch of volumes for the Treatise project: This is the batch consisting of Volumes 9 and 10, namely, A History of the P- losophy of Law in the Civil Law World, 1600–1900, edited by Damiano Canale, Paolo Grossi, and Hasso Hofmann, and The Philosophers’ Philosophy of Law from the Seventeenth Century to Our Days, by Patrick Riley. Three v- umes will follow: Two are devoted to the philosophy of law in the 20th c- tury, and the third one will be the index for the entire Treatise, which will 1 therefore ultimately comprise thirteen volumes. This Volume 9 runs parallel to Volume 8, A History of the Philosophy of Law in the Common Law World, 1600–1900, by Michael Lobban, published in 2007. Volume 10, for its part, takes up where Volume 6 left off: which appeared under the title A History of the Philosophy of Law from the Ancient Greeks to the Scholastics (edited by Fred Miller Jr. in association with Carrie-Ann Biondi, likewise published in 2007), and which is mainly a history of the p- losophers’ philosophy of law (let us refer to this philosophy as A).
L'Europa del diritto
«Vogliamo sottolineare al lettore che il diritto, anche se le sue manifestazioni più vistose sono in solenni atti legislativi, appartiene alla società e quindi alla vita, esprime la società più che lo Stato, è il tessuto invisibile che rende ordinata la nostra esperienza quotidiana, consentendo la convivenza pacifica delle reciproche libertà. Consapevoli di tutto questo, cercheremo nelle pagine che seguono di dominare l'interezza del paesaggio giuridico. Non dimenticheremo mai cioè che il diritto è una mentalità, esprime un costume e lo ordina. Per questo dedicheremo una prevalente attenzione al diritto che ordina la vita quotidiana dei privati. Il nostro cammino è lungo: più di millecinquecento anni.» Paolo Grossi ripercorre una dimensione della storia generalmente trascurata, quella giuridica. Il criterio metodologico che guida il suo percorso di rigorosa sintesi è quello di comparare e distinguere le diverse esperienze giuridiche dell'Europa medievale, moderna e postmoderna. Non un itinerario filato e continuo, ma piuttosto tre momenti di forte discontinuità, tre maturità di tempi da contemplare e decifrare nel pieno rispetto delle loro autonome fondazioni.
L'invenzione del diritto
Il diritto non piove dall'alto sulle teste dei cittadini. Al contrario, è qualcosa che si trova nelle radici di una civiltà, nel profondo della sua storia, nell'identità di una coscienza collettiva. Deve essere identificato negli strati profondi della società, laddove allignano i valori fondamentali. La riflessione originale di un grande Maestro sul ruolo cruciale del diritto per la convivenza umana.
Oltre la legalità
Ripensare criticamente i due pilastri fondamentali del moderno 'Stato di diritto': la separazione dei poteri e il principio di legalità. Paolo Grossi – uno dei più grandi giuristi italiani – ritiene assolutamente indispensabile una loro non marginale revisione. È necessaria una innovata visione di un ordine giuridico italiano che non si riduca e non si risolva soltanto in leggi dello Stato. Solo così si può attuare il pluralismo giuridico della nostra Costituzione: ritrovando la sua naturale complessità quale specchio fedele della realtà complessa della società.
