Originally an important but relatively obscure plurilateral instrument, the WTO Agreement on Government Procurement (GPA) is now becoming a pillar of the WTO system as a result of important developments since the Uruguay Round. Die öffentliche Hand tritt vermehrt selbst als Bieter in Vergabeverfahren auf. Gegenstand ihres Interesses ist es, Leistungen der Daseinsvorsorge zu rekommunalisieren. Die Arbeit untersucht, ob und welchen vergaberechtlichen Bindungen die Öffentliche Hand dabei unterliegt. Ausgehend vom primär- und verfassungsvergaberechtlichen Rahmen wird die Bedeutung des Kartellvergaberechts, der Verordnung (EG) 1370/2007, des § 46 EnWG und des Haushaltsvergaberechts für den Aufgabenzugriff der Öffentlichen Hand entfaltet. Auf einer tieferliegenden Ebene wird untersucht, ob Primär- und Verfassungsrecht vergaberechtliche Privilegien der Öffentlichen Hand wie die Inhouse-Ausnahme begrenzen oder ob sie vielmehr einer vergabewettbewerblichen Strukturierung des binnenorganisatorischen Bereichs der Verwaltung entgegenstehen.
