Traumatic Divorce and Separation

This book is an integration of the study of trauma, divorce, and separation impacted by domestic violence, substance abuse, and mental illness. While the original research on divorce took place at roughly the same time as the field of trauma, social scientists did not integrate an understanding of trauma into their understanding of domestic violence and divorce. During divorce, such families are impacted by a history of traumatic exposure to abuse and require court intervention that cannot be addressed by mediation or alternative dispute resolution. They require a trauma-informed interdisciplinary response. The text also discusses gender bias against women in the courts and the gender bias task force movement.

Beyond Straight and Gay Marriage

Part of the Queer Ideas series, edited by Michael Bronski QUEER IDEAS-a new series of LGBT hardcovers that address important intellectual questions facing the movement. The debate over marriage equality for same-sex couples rages across the country. Beyond (Straight and Gay) Marriage boldly moves the discussion forward by focusing on the larger, more fundamental issue of marriage and the law. The root problem, asserts law professor and LGBT rights activist Nancy Polikoff, is that marriage is a bright dividing line between those relationships that legally matter and those that don't. A woman married to a man for nine months is entitled to Social Security survivor's benefits when he dies; a wo...

Good Intentions Gone Awry

Based on sociological and economic analysis, Good Intentions Gone Awry presents valuable new insights into the impact of divorce on American society. Rather than blaming the deterioration in the quality of family life on the decline in so-called "family values," lawyer and economist Parkman argues that adults are responding to the incentives created by new opportunities and legal rules. Allen M. Parkman discusses the issues surrounding this sociological phenomena, proposes a reform program in response, and suggests steps that adults can take to create a durable and constructive family until such reforms occur.

A stunningly original history of higher education law. Conventional wisdom holds that American courts historically deferred to institutions of higher learning in most matters involving student conduct and access. Historian Scott M. Gelber upends this theory, arguing that colleges and universities never really enjoyed an overriding judicial privilege. Focusing on admissions, expulsion, and tuition litigation, Courtrooms and Classrooms reveals that judicial scrutiny of college access was especially robust during the nineteenth century, when colleges struggled to differentiate themselves from common schools that were expected to educate virtually all students. During the early twentieth century...

Beneath the Fault Line

DiFonzo's study focuses mainly on the cultural trend toward acceptance. Although he uses formal records such as law texts, statutes, and the decisions of trial and appellate courts, his primary sources are the popular presses of the time, with their opinions, criticisms, and even parodies of divorce and divorce legislation.

Marriage and Same-Sex Unions

This book exemplifies the high quality of thoughtful discussion and debate that is possible on the issue of same-sex marriage. Authors are paired to address and respond to a particular topic, one in favor of state recognition of same-sex relationships, and one in favor of limiting state recognition to those relationships that have been traditionally recognized as marriages. Proposals to legalize same-sex marriage evoke strong response from those on both sides of the debate. Much has been written about the legal policy issues over the legal recognition of same-sex unions in the United States, yet there has been little dialogue and exchange between participants in the debate. This book attempt...
