Justicia, verdad y prueba
¿Por qué importa la verdad de los hechos en el Derecho? ¿Existe alguna metodología que nos conduzca hacia tal verdad? ¿influye en su búsqueda la forma cómo se organiza el proceso? En este volumen, Susan Haack, responde éstas y otras cuestiones fundamentales sobre la relevancia que tiene para la justicia, una adecuada teoría sobre la verdad y sobre la prueba. Según argumenta, la justicia material solo es posible si: (i) existe algo así como una verdad fáctica; ii) tal verdad es objetiva, es decir, no es cuestión de lo que cualquiera, o incluso todo el mundo, crea; y iii) es posible con cierta frecuencia, para cualquiera, establecer cuál es la verdad de una cuestión sobre los hechos en disputa. Este último punto, a su vez, requiere; iv) que existan estándares objetivos que nos permitan asegurar que una prueba sea mejor o peor; y, v) que el hecho de que las pruebas que sustentan una afirmación sean buenas, según tales estándares, sea al menos una indicación falible de que probablemente la afirmación en cuestión es verdadera.
