This book tells the story of how the business community, and the trade associations and think tanks that it created, launched three powerful assaults during the last quarter of the twentieth century on the federal regulatory system and the state civil justice system to accomplish a revival of the laissez faire political economy that dominated Gilded Age America. Although the consequences of these assaults became painfully apparent in a confluence of crises during the early twenty-first century, the patch-and-repair fixes that Congress and the Obama administration put into place did little to change the underlying laissez faire ideology and practice that continues to dominate the American political economy. The book presents two core proposals, an Environmental Legacy Act to preserve a defined environmental legacy for future generations and an Environmental Competition Statute to spark movement to new clean technologies. The first proposal would require, for the first time, that the federal government define an environmental legacy that it must preserve for future generations. The second would establish a market competition to maximize environmental protection. The balance of the book provides complementary proposals and analysis. The first generation of environmental law sought broad protection of health and the environment in a fairly fragmented way. The second sought to enhance environmental law's efficiency through cost-benefit analysis and market mechanisms. These proposals seek to create a broader, more creative approach to solving environmental problems.
Environmental Policymaking
The methods employed in the pursuit of environmental protection are often highly contested, leading to alternative policy approaches. This book details the frequently neglected topic of these alternative approaches to environmental policymaking through case studies drawn primarily from the United States, Germany, and Japan. Among the policy instruments analyzed are eco-audits, voluntary agreements, tradable permits, green taxes, environmental impact assessments, and command and control regulations. Also examined are international regulatory arrangements to encourage sustainable forestry management practices. Various evaluative criteria are applied to each case study, including environmental effectiveness, economic and political efficiency, administrative efficacy, and technological innovation.
