DIREITO PENAL EMPRESARIAL
A atual percepção do Direito Penal Empresarial pode ser vista dentro de uma nova perspectiva de expansão do Direito Penal. Em um momento anterior, a construção penal sustentava a necessidade de antecipação da resposta penal. Mais recentemente, buscando a superação dos problemas sentidos sentidos na utilização dos crimes de perigo abstrato, a dogmática penal acaba por propor uma leitura interpretativa da atuação do empresário como garantidor dos riscos da empresa. Nesse sentido, a sua responsabilização se dá, necessariamente, através da responsabilização por condutas omissivas em relação à vigilância e ao controle que deve ser exercida em relação ao atuar empresarial. A tentativa de conter tal entendimento expansionista, que acaba por incidir em uma leitura artificial do Direito Penal é a proposta do presente trabalho, destinado a profissionais e estudantes de Direito.
