International Criminal Law

  • Categories: Law

At the dawn of the International Criminal Court, the rich experience of the "ad hoc" International Criminal Tribunal for the former Yugoslavia (ICTY) will prove to be the primary source of legal authorities for many years. The creation of the ICTY in 1993 heralded a new-found willingness of the international community to bring to book perpetrators of war crimes and gross or systematic violations of human rights. Written by academics and practitioners, and notably many "insiders" at the ICTY, this volume focuses particularly on the international and criminal law developments that have taken place in the practice and procedure of the Tribunal. Throughout are threads concerning the development and application of international criminal law not only by the ICTY, but also by the "ad hoc" International Criminal Tribunal for Rwanda and the new International Criminal Court.

Digest of Jurisprudence of the Special Court for Sierra Leone

The Special Court for Sierra Leone was created in 2002 to prosecute "persons who bear the greatest responsibility" for serious violations of international humanitarian law and Sierra Leonean law in Sierra Leone since 30 November 1996. It started delivering decisions in March 2003 and should complete its work by the end of 2007. The present Digest is a collection of the most relevant abstracts of decisions and orders rendered by Chambers - Trial Chambers, Appeals Chamber, President - between March 2003 and 31 December 2005. 548 public decisions have been reviewed for its preparation. The abstracts have been selected on the basis of their relevance to the interpretation and application of the Statute and Rules of Procedure and Evidence or of their importance in the development of international criminal law. This Digest is devised as a tool for practitioners of international law and academics, which will assist them in discovering the substantial work of the Special Court.

Victims Before the International Criminal Court

  • Categories: Law

The book analyses the difficulties the International Criminal Court faces with the definition of those persons who are eligible for participating in the proceedings. Establishing justice for victims is one of the most important aims of the court. It therefore created a unique system of victim participation. Since its first trial the court struggles to live up to the expectancies its statute has generated. The book offers a new approach of how to define victimhood by looking at the different international crimes. It seeks to offer guidance for the right to participate in the different stages of the proceedings by looking at the practice in national jurisdictions. Lastly the book offers insights into the functioning of the reparation regime at the ICC by virtue of the Trust Fund for Victim and its different mandates. The critical analysis of the ICC-practice with regard to definition, participation and reparation aims at promoting a realistic approach, which will avoid the disappointing of expectations and thus help to enhance the acceptance of the ICC.

Refugee Pathways to Freedom

Janet Mancini Billson provides extended interviews with Russian, Bhutanese, Rohingya, and Kurdish refugees, and the resettlement workers who smooth their transition into Canada, in order to paint a complex picture of creating a new life in a new land. Refugee Pathways to Freedom: Escaping Persecution and Statelessness shows how the agonies of losing one’s home and leaving loved ones behind are coupled with the dangers of escaping into unknown territory, and that those who make the journey to freedom know that the dream of a safe and secure future is fraught with risks and disappointment. She argues that refugees and refugee agencies bring powerful ideas for revamping an overwhelmed global system that freezes victims of persecution in years of political and emotional limbo. She examines how shrinking refugee flows by addressing root causes of displacement is critical, but so is speeding up selection processes to reduce despair and lost years. She further posits that drastically limiting time in refugee camps would prevent counterproductive education and work gaps and that reducing language barriers to employment ensures well-being and successful integration.

The Prosecution and Defense of Peacekeepers under International Criminal Law is the first comprehensive study on the international judicial implications of prosecution of international peacekeepers and members of military crisis operations under the principles of international criminal law and especially those of the International Criminal Court (ICC). Based on both domestic case law and that of the ICTY-ICTR, this study analyzes the foundation and application of international criminal liability concepts and defenses from the perspective of the prosecution and defense in the area of peacekeeping. This book assesses whether prosecution of international peacekeepers merits a distinct judicial position due to (UN) peacekeeping mandates as well as the concept of Rules of Engagement. Special attention is paid to the new era of international military crisis operations in terms of prosecution and defense of military servicemen involved in these operations. Published under the Transnational Publishers imprint.
