Democracy and Islam in Indonesia

In 1998, Indonesia's military government collapsed, creating a crisis that many believed would derail its democratic transition. Yet the world's most populous Muslim country continues to receive high marks from democracy-ranking organizations. In this volume, political scientists, religious scholars, legal theorists, and anthropologists examine Indonesia's transition compared to Chile, Spain, India, and potentially Tunisia, and democratic failures in Yugoslavia, Egypt, and Iran. Chapters explore religion and politics and Muslims' support for democracy before change.

The Indonesian Presidency

This pioneering study of the Indonesian presidency significantly redefines our understanding of Indonesian politics from independence to the present. Angus McIntyre blends political biography with constitutional history to locate Indonesian leaders within both Indonesian cultural frameworks and the global biographical literature on political leaders. The Indonesian Presidency shows how Indonesia's 1945 constitution provided first for the personal rule of presidents Sukarno and Soeharto and then facilitated the shift towards constitutional rule that marked the presidencies of B.J. Habibie, Abdurrahman Wahid, and Megawati Sukarnoputri. This important study elevates the personalities of Sukarno ...

The Death of Authentic Primitive Art

  • Categories: Art

In this lucid, witty, and forceful book, Shelly Errington argues that Primitive Art was invented as a new type of art object at the beginning of the twentieth century but that now, at the century's end, it has died a double but contradictory death. Authenticity and primitivism, both attacked by cultural critics, have died as concepts. At the same time, the penetration of nation-states, the tourist industry, and transnational corporations into regions that formerly produced these artifacts has severely reduced supplies of "primitive art," bringing about a second "death." Errington argues that the construction of the primitive in the nineteenth and twentieth centuries (and the kinds of objects...

While there are several texts that focus on forensic science techniques and applications, there are few to no quality books that adequately address the judicial interpretation of forensic legal and scientific principles. The field of forensic science and law has long been in need of a historic casebook. Forensic Law Casebook: Judicial Reasoning and the Application of Forensic Science in Criminal Cases fills the current void by reviewing actual case law and translating the practical application of science to the courtroom. Each chapter represents a unique forensic discipline, providing a short introduction to the subject matter, the relevant case law and court cases that pertain to that subje...

This book addresses critical questions about how legal development works in practice. Can law be employed to shape behavior as a form of social engineering, or must social behavior change first, relegating legal change to follow as ratification or reinforcement? And what is legal development's source of legitimacy if not modernization? But by the same token, whose version of modernization will predominate absent a Western monopoly on change? There are now legal development alternatives, especially from Asia, so we need a better way to ask the right questions of different approaches primarily in (non-Western) Asia, Africa, the Islamic world, plus South America. Incoming waves of change like t...

Since 1987, there have been 49 inmate deaths in jails and prisons across the state of Mississippi. No study has been produced or written to explicate why such deaths have occurred in Mississippi's jails. Most of the deaths have been labeled suicide, but further research by the author has led to other explanations that these deaths were not all suicide. Many of the victims were African American, male, young and with no previous history of arrests. Within 24 hours of being incarcerated, many of these pre-trial detainees were found hanged in their jail cells with larynx and muscles missing, tongue cut out and body covered with bruises.

In the literature on Indonesian legal history, the role of language has been paid scant attention. Even the replacement of Dutch by Indonesian as the official language of the law, surely a major event for the work of Indonesian jurists, has not been closely examined. Yet, since the early 1970s, legal usage and terminology have been the topic of a steady stream of highly critical publications by linguists and, remarkably, by jurists as well. Their criticism is focused on the heterogeneity of law language and terminology, and the deviation of legal usage from the official standard language. Government measures (language courses, law dictionaries) have not allayed this criticism. This study exp...
