Embora esta ligação nos tenha sido sugerida há longo tempo por vários filósofos, só nos últimos anos se verificou um aprofundamento da investigação ao nível das ciências sociais sobre este tema, e a experiência empírica veio confirmar o que já há muito se intuía: certos objectos são constitutivos da personalidade, na medida em que permitem ao ser humano desenvolver-se na sua individualidade e apresentar-se socialmente com uma identidade específica. O que nós procurámos, no trabalho que agora apresentamos, foi averiguar se esta premissa era importante para o Direito Civil e, em particular, se seria susceptível de fundamentar uma diferente afectação de direitos reais, ou, dito de outro modo, se estes, em virtude da sua ligação à personalidade, são merecedores de uma especial tutela do Direito.
