How do states violate human rights norms after legalization? Why are these violations so persistent? What are the limits of legalization for protecting human rights norms? Conventional wisdom offers a variety of answers to these questions, but most often they conflate laws and norms and focus only on state actions that violate both. This book investigates the connection between tightening mobilization constraints and the use of PMSCs in the United States, the United Kingdom, and Italy. Drawing on neoclassical realism and institutionalist theory, it conceptualizes democracies’ use of private military and security companies (PMSCs) as an attempt to circumvent the tightening constraints on the mobilization of military power. The use of private military contractors is less subjected to parliamentary restrictions and less visible to public opinion than the deployment of soldiers. Rather than cheaper in financial terms, PMSCs are therefore politically cost-effective, as they enable decision-makers to minimize the institutional obstacles on conducting military operations and the electoral costs attached thereto. The need to reduce the ex ante hurdles and the ex post costs of military deployments fills the blind spots of alternative explanations for the use of PMSCs based on effectiveness, ideology, and organizational interests.

Barack Obama’s "rebalancing" or "pivot" strategy, intended to demonstrate continued US commitment to the Asia-Pacific region in a variety of military, economic, and diplomatic contexts, was launched with much fanfare in 2011. Implicit in the new strategy is both a focus on China – engagement with, and containment of – and a heavy reliance by the United States on its existing friends and allies in the region in order to implement its strategy. This book explains why there is a pronounced disjuncture between R2P's habitual invocation and its actual influence, and why it will not make the transformative progress its proponents claim. Rather than disputing that R2P is a norm, or declaring that norms are insignificant, Hehir engages with post-positivist constructivist accounts on the role of norms to demonstrate first, that the efficacy of a norm is not directly related to the extent to which it is proliferated or invoked, and second, that in the post-institutionalization phase, norms undergo both contestation and (potentially regressive) reinterpretation. This volume analyses the evolution of R2P, and demonstrates that it has been steadily circumscribed and co-opted, so that today it has no power to meaningfully influence the behaviour of states.
