This volume is a comprehensive treatment of the African human rights system in terms of the laws, practice, and institutions of the system. The volume discusses, analyzes, and evaluates normative instruments of the African system: the Charter of the Organization of the African Unity (OAU), and the African Charter on Human and Peoples' Rights, presenting article-by-article analysis of its provisions and those of the Protocol on the Establishment of the African Court on Human and Peoples' Rights. Similarly the OAU (now the African Union), the African Commission on Human and Peoples' Rights, and the proposed African Court on Human Rights, as institutions of the system, are discussed. The book emphasizes a comparative approach and presents a summary of the UN, the European and the Inter-American human rights mechanisms with regard to their impact on the African system. The role of NGOs in the African system is also considered, as well as the controversial issue of human rights in pre-colonial and colonial Africa.

The World Bank Legal Review, Volume 5

  • Categories: Law

This volume will explore the potentially transformative role of effective laws and legal institutions in providing people with more opportunity that is both inclusive and equitable. Laws, legal frameworks and judicial institutions can create opportunity by providing the space to build human capital and assets, create jobs, and encourage individuals and organizations to make productive investments based on a greater sense of stability. They can also promote inclusion by advancing access to jobs and expanding the reach and quality of services including access to justice as well as promote equity by supporting equal opportunities, promoting open and accountable governance, and effective judicial and legal institutions. The objective is to shift focus to laws, legal frameworks and judicial institutions. To this end, submissions will explore the potentially transformative role of effective laws and legal institutions in providing people with more opportunity that is both inclusive and equitable.

Africa and the Future of International Criminal Justice

  • Categories: Law

This collection examines the critical issues concerning Africa as a place where international criminal accountability mechanisms have played, and continue to play, a prominent role in the efforts to deal with and to tackle impunity for atrocity crimes. It looks at Africa's importance to international criminal justice as exemplified by the activities of international criminal accountability mechanisms, such as the International Criminal Tribunal for Rwanda, the Special Court for Sierra Leone, and the International Criminal Court (ICC). The book discusses the contentions about whether Africa is particularly targeted for international justice accountability experiments, as well as the politics ...

This book offers the first comprehensive and in-depth analysis of the provisions of the ‘Malabo Protocol’—the amendment protocol to the Statute of the African Court of Justice and Human and Peoples’ Rights—adopted by the African Union at its 2014 Summit in Malabo, Equatorial Guinea. In this book, leading experts in the field of international criminal law analyze the main provisions of the Annex to the Malabo ...

‘Green Crimes and International Criminal Law’ examines crimes against the environment, which impact not only humans, but also wildlife and ecosystems more generally. A significant point of discussion in the volume is whether green crimes can fit effectively into existing international criminal law frameworks or not. Chapter authors explore these crimes from both a definitional and theoretical perspective and in various contexts in different parts of the world, questioning whether these violations have led to or are violations of international criminal law. While the recognition of green crimes in the international criminal law community has been slow, it has increasingly gained widesprea...
