The different contributions of this body of work attemp to demonstrate that the concept of diaspora (exile) has acquired a renewed currency among scholars by examining that to be in exile, at least in some way, is to live a disjoint life. Thus, to live in exileor diaspora implies to take up the difficult task of kee-ping one`s dignity and one ́s story, despite the on slaught of a colonial power. The relationship with a past, often through stories of the mother/land or through remembrance and (re)creation, becomes a means of survival. Futhermore, the sense (or absence) of community, and the positioning in language generate an ever more complex and dialogic definition of Canadian and American nationalities and identities.

Diaspora, Law and Literature

The well-known challenges of international migration have triggered new departures in academic approaches, with 'diaspora studies' evolving as an interdisciplinary and even transdisciplinary field of study. Its emerging methodology shares concerns with another interdisciplinary field, the study of the relations between law and literature, which focuses on the ways in which the two cultural practices of law and literature mutually negotiate each other and on the question after the ontological commensurability of the domains. This volume offers, for the first time, an attempt to provide an interface between these overlapping interdisciplinary endeavours of literary studies, legal studies, and diaspora studies. In doing so, it explores new approaches and invites new perspectives on diasporas, migration and the disciplines that study them, hopefull also adding to the cultural resources of coping with a swiftly changing social landscape in a globalizing world.

This book examines the distinction between literary expatriation and exile through a 'contrapuntal reading' of modern Palestinian and American writing. It argues that exile, in the Palestinian case especially, is a political catastrophe; it is banishment by a colonial power. It suggests that, unlike expatriation (a choice of a foreign land over one’s own), exile is a political rather than an artistic concept and is forced rather than voluntary — while exile can be emancipatory, it is always an unwelcome loss. In addition to its historical dimension, exile also entails a different perception of return to expatriation. This book frames expatriates as quintessentially American, particularly intellectuals and artists seeking a space of creativity and social dissidence in the experience of living away from home. At the heart of both literary discourses, however, is a preoccupation with home, belonging, identity, language, mobility and homecoming.
