The Judiciary between Management and the Rule of Law

La justice entre le management et l'État de droit
La présente publication rassemble les résultats consolidés du projet de recherche interdisciplinaire "Fondements d'un bon management de la justice en Suisse" soutenu par le Fonds national suisse de la recherche scientifique. Elle contient des contributions touchant des domaines clés de l'organisation de la justice. Sont thématisées d'une part des questions fondamentales de droit public et institutionnelles sur la surveillance et la protection de la personnalité. On y trouve d'autre part des enseignements sur l'environnement de la justice et les ressources avec un accent placé sur la gestion de la charge de travail. Elle aborde en outre la qualité au sein des tribunaux ainsi que la thématique de l'organisation et de l'image du juge ou encore de la culture judiciaire. Der Einfluss kantonaler Justizsysteme auf das Vertrauen der Bevölkerung in die Gerichte
Die Justiz ist in hohem Masse vom Vertrauen der Bevölkerung abhängig. Die vorliegende Publikation untersucht aus einer politikwissenschaftlichen Perspektive, wie hoch dieses Vertrauen in die Gerichte der Schweizer Kantone ist und welches die Ursachen für Unterschiede im Vertrauen sind. Durch die grosse Heterogenität der Justizorganisation in den 26 Kantonen ist es möglich, insbesondere institutionellen Erklärungsfaktoren nachzugehen. Mittels quantitativer Analysen kann der Autor aufzeigen, welche Faktoren einen signifikanten Einfluss auf das Vertrauen der Bevölkerung in Gerichte haben. Aus den Resultaten werden Schlussfolgerungen für die Justizbehörden und die Politik abgeleitet. Dabei wird illustriert, wie das Vertrauen in die Gerichte gestärkt, respektive wie einem Vertrauensverlust entgegen gewirkt werden kann.
