Electing Hong Kong's Chief Executive

In 2007, the Hong Kong Special Administrative Region held its first-ever contested election for Chief Executive, selected by 800 members of an Election Committee drawn from roughly 7% of the population. The outcome was a foregone conclusion, but the process allowed a pro-democracy legislator to obtain enough nominations to contest the election. The office of Chief Executive is as unique as the system used to fill the office, distinct from colonial governors and other leaders a Chinese provinces and municipalities. The head of the HKSAR enjoys greater autonomous powers, such as powers to nominate principal officials for Chinese appointment, pardon offenders and appoint judges. Despite its many anti-democratic features, the Election Committee has generated behavior typically associated with elections in leading capitalist democracies and has also gained prominence on the mainland as the vehicle for returning Hong Kong deputies to the National People's Congress. This book reviews the history and development of the Election Committee (and its predecessor), discusses its ties to legislative assemblies in Hong Kong and Mainland China, and reflects on the future of the system.

The Minjian Avant-Garde

  • Categories: Art

The Minjian Avant-Garde studies how experimental artists in China mixed with, brought changes to, and let themselves be transformed by minjian, the volatile and diverse public of the post-Mao era. Departing from the usual emphasis on art institutions, global markets, or artists' communities, Chang Tan proposes a new analytical framework in the theories of socially engaged art that stresses the critical agency of participants, the affective functions of objects, and the versatility of the artists in diverse sociopolitical spheres. Drawing from hitherto untapped archival materials and interviews with the artists, Tan challenges the views of Chinese artists as either dissidents or conformists t...

Christian Social Activism and Rule of Law in Chinese Societies

Although Christianity has been a minority religion in Chinese societies, Christians have been powerful catalysts of social activism in seeking to establish democracy and rule of law in mainland China, Taiwan, Hong Kong, and diasporic communities. The chapters gathered in this collection reveal the vital influence of Christian individuals and groups on social, political, and legal activism in Chinese societies. Written from a range of disciplinary and geographical perspectives, the chapters develop a coherent narrative of Christian activism that illuminates its specific historical, theological, and cultural contexts. Analyzing campaigns for human rights, universal suffrage, and other political reforms, this volume uncovers the complex dynamics of Christian activism, highlighting its significant contributions to the democratization of Greater China.

The Judicial Construction of Hong Kong’s Basic Law

  • Categories: Law

China has granted Hong Kong a high degree of autonomy through the Basic Law under the principle of “one country, two systems”. Hong Kong’s legal system under the Basic Law is based on the common law and is administered by independent courts. By interpreting the Basic Law, Hong Kong’s courts have reviewed legislation and executive decisions, and have achieved a “second founding” of the Basic Law as an enforceable constitution. This book is the first comprehensive account of how the Hong Kong courts gained this vital power of judicial review. Through an analysis of important court cases since 1997, the book also examines how the Hong Kong courts maintain their relationships with th...
