Collected Edition of the "Travaux Préparatoires" of the European Convention on Human Rights: Legal Committee, Ad Hoc Joint Committee, Committee of Ministers, Consultative Assembly, 23 June-28 August 1950

The European Convention on Human Rights is undoubtedly the most concrete expression by the Member States of the Council of Europe of their profound belief in the values of democracy, peace & justice and, through them, respect for the rights & fundamental freedoms of persons living in our society. Although this instrument is over forty years old, it has evolved & continues to do so, not only through the case law of the European Commission & Court of Human Rights, but also through the addition of Protocols strengthening the rights & improving the protection mechanism. This revised edition of the 1987 Collected Texts gives lawyers & any other interested persons clear & up-to-date information on all these instruments & on the texts relating to the working of the bodies set up by the Convention. The basic instruments & texts contained in the 1994 Collected Texts (English & French) provide a vital tool for all those working for human rights in Europe.

Law and Practice of the European Convention on Human Rights and the European Social Charter

  • Categories: Law

Council of Europe Publishing brings together in one book a comprehensive explanation of the two main human rights texts encompassing both civil & political rights & economic, social & cultural rights: the European Convention on Human Rights & the European Social Charter. This book explains both the substantive legal standards contained in the Convention & the Charter & the means by which those standards evolve in response to a changing Europe. In the form of over 300 case studies, it brings to life concrete situations in which these rights have been questioned & defended. This book is targeted at university students in international law & at all those interested in the human rights challenge in Europe. But it also sheds light on similarities with other national structures, in the US & in a number of Commonwealth countries.

The Legal Status of Migrants Admitted for Employment

Recent trends indicate that European countries are admitting more foreign workers to fill labour shortages caused by ageing populations and the increasing globalisation. Consequently, some European countries have adopted new laws and policies in order to attract both highly-skilled and less skilled foreign workers. However, the legal status of these migrants has become a matter of concern. The new measures do not entirely meet the established principles and standards of the Council of Europe aimed at protecting the rights of migrant workers, such as those of the European Social Charter and the European Convention on the Legal Status of Migrant Workers. This study focuses on the rules relating to the legal status of the main categories of migrant workers admitted for employment in some Council of Europe member states. It considers the important question of whether these national rules are structured in a way to assist migrants in their integration in the host country, in terms of granting them a secure residence status and economic and social rights, or whether they discourage or even prevent such integration.

Monitoring Fundamental Rights in the EU

  • Categories: Law

Coherent laws enforced by a central authority are part of the reason why human rights protection works at the national level in Europe. But when it comes to the EU these dimensions are lacking. The present system for protecting fundamental rights emerged on an ad hoc basis, with measures being improvised to respond to particular problems. In the next couple of years, however, this situation is likely to change very significantly. The proposed European Constitution incorporates the EU Charter of Fundamental Rights, and a specialized EU Fundamental Rights Agency is likely to be established. As a result, the situation of the EU will more closely resemble that of its Member States. Fundamental r...
