Judicialización estratégica de homicidios y feminicidios en México
¿Qué impide o promueve que un posible delito se judicialice en México? Aquí se aborda este problema actual y crítico de la procuración de justicia; cómo impactan los actores políticos o societales y los operadores en la capacidad de las fiscalías para la judicialización, es decir, en su eficiencia para conducir a los tribunales de primera instancia los posibles delitos. La autora ha diseñado una teoría que integra los aportes de la literatura previa para mostrarnos cuál es el papel que, en este asunto central para la seguridad pública y los derechos humanos, juegan las relaciones de poder y las alianzas de grupos pro justicia o los pro impunidad. Con los casos de las procuradurías de Nuevo León y Nayarit en su atención a homicidios y feminicidios, se ilustra que una alianza entre titular del Ejecutivo, fiscal general y grupos pro justicia produce altos niveles de judicialización delictiva; pero si esa alianza ocurre con los pro impunidad se genera una crisis de seguridad y derechos humanos como la que hoy se vive en México.
