A Common Law for the Age of Statutes

  • Categories: Law

Calabresi complains that we are "choking on statutes" and proposes a restoration of the courts to their common law function. From a series of lectures given by Calabresi as part of The Oliver Wendell Holmes Lectures delivered at Harvard Law School in March 1977. "In his most recent publication, A Common Law for the Age of Statutes, based on the Oliver Wendell Holmes lectures he delivered at Harvard in March of 1977, Professor Calabresi has brought his ample juristic talents to bear on a foundational problem of the legal and democratic process. He has produced a monograph that in its quality, timeliness and provocativeness is likely to stand alongside the seminal works of Ronald Dworkin and Grant Gilmore." --Allan C. Hutchinson and Derek Morgan, 82 Columbia Law Review (1982) 1752. GUIDO CALABRESI [b. 1932] is Sterling Emeritus Professor of Law and Professorial Lecturer in Law at Yale Law School. He was Dean of Yale Law School from 1985-1994 and became a United States Circuit Judge in 1994. He is also the author of The Costs of Accidents (1970), Tragic Choices (1978) and Ideals, Beliefs, Attitudes, and the Law (1985).

Early Modern Art Theory. Visual Culture and Ideology, 1400-1700

  • Categories: Art

The development of art theory over the course of the Renaissance and Baroque eras is reflected in major stylistic shifts. In order to elucidate the relationship between theory and practice, we must consider the wider connections between art theory, poetic theory, natural philosophy, and related epistemological matrices. Investigating the interdisciplinary reality of framing art-making and interpretation, this treatment rejects the dominant synchronic approach to history and historiography and seeks to present anew a narrative that ties together various formal approaches, focusing on stylistic transformation in particular artist’s oeuvres – Michelangelo, Annibale Carracci, Guercino, Guido Reni, Poussin, and others – and the contemporary environments that facilitated them. Through the dual understanding of the art-theoretical concept of the Idea, an evolution will be revealed that illustrates the embittered battles over style and the overarching intellectual shifts in the period between art production and conceptualization based on Aristotelian and Platonic notions of creativity, beauty and the goal of art as an exercise in encapsulating the “divine” truth of nature.

American Ideas for English Readers

An impression has prevailed—and has gained credence at some times and in some places, that, in his later years, and in the presence of a society differently organized from that which he found at home, the ardor of his love of country was quenched:—that he became less an American as he saw more of other lands. What is it to be an American? The definition may vary, in different regions. What was it, always, with him? If to be an American means merely to be successful in a large and worldly way—whether in politics, or in business, or in letters; to out-talk, out-spend, out-bid, out-invent others; to drive faster; to travel farther; to push harder; to build bigger houses; to found more ric...

The Sixth Son is the second novel of a trilogy on human trafficking involving US Homeland Security Investigations (HSI) and their relentless effort to curb Mexican cartel shipments of kidnapped women and children across the US border. Unlike the prequel, The Old Cop, which involved a retired US Agent, Agustín Camelia's intrepid efforts to battle this evil, The Sixth Son concerns the struggles of a highly regarded Maryland family, the Mancinis, who recently made a bizarre discovery about their late patriarch, Geovani Mancini, who migrated to the US from Sicily in 1939 with the assistance of Sicilian mafia members. Unknown dubious New York relations now threaten to tear the family apart. Geov...
