The original Latin text of Johann Gröning’s Navigatio libera has never before been translated into any modern vernacular language. Gröning’s intention was to set out the position of neutral nations (in this case the Danes and Swedes), and their right to pursue trade during the wars of the great maritime powers (particularly the English and the Dutch). It specifically sought to engage with and refute the work of Hugo Grotius while taking cognisance of the critique of Gröning’s work by Samuel Pufendorf. The text serves as a bridge between 17th-century polemical discourse surrounding the ‘free sea’ versus ‘enclosed sea’ debate and later 18th-century legal literature on the rights of neutrals and the continuation of free trade in time of war.
Der norddeutsche Jurist David Mevius zählt zu den großen europäischen Gestalten des Usus modernus. Hier wird erstmals sein gesetzgeberisches Hauptwerk in der von ihm verfassten Originalversion im Druck zugänglich gemacht. Der Schwerpunkt der Einleitung beleuchtet einzelne Stellen des Landrechtsentwurfs und führt das Gesetzesverständnis von Mevius, seine Rechtsquellenlehre und Gesetzgebungstechnik vor Augen. Die Editionsrichtlinien geben Aufschluss, in welcher Weise die philologischen Besonderheiten und die Unterschiede zwischen der Handschrift und dem frühneuzeitlichen Druck nachgewiesen sind. Das umfangreiche Register soll den Weg zur Quelle erleichtern. Die norddeutsche Rechtsgeschichte und die Landesgeschichte werden vielfache Hinweise auf die Lebens- und Rechtskultur der ländlichen Gesellschaft finden. Die Dogmengeschichte kann die Lösungen des Landrechtsentwurfs in die übergreifenden Strömungen des Usus modernus einordnen. Die inhaltliche Auswertung des mecklenburgischen Landrechtsentwurfs ist damit auf gesicherter Grundlage möglich.
Das Hauptgebäude der Universität Rostock wurde jüngst umfassend saniert und, soweit möglich, denkmalgeschützt in dem Zustand seiner Bauzeit wiederhergestellt. Das Hauptgebäude entstand unter der Bauleitung des Architekten Hermann Willebrand von 1867 bis 1870 im Stil der mecklenburgischen Terrakotta-Renaissance des ausgehenden 16. Jahrhunderts. Mit diesem schlossähnlichen Bau brachte Großherzog Friedrich Franz II. seine Fürsorge für die Wissenschaft zum Ausdruck. Der vorliegende Sammelband dokumentiert umfassend die Planungs-, Bau- und Nutzungsgeschichte von der Mitte des 19. Jahrhunderts bis in die Gegenwart. Neun historische Aufsätze, zwei Zeitzeugenberichte über die aktuelle Sanierung und zahlreiche Abbildungen vermitteln die Geschichte dieses ebenso nützlichen wie schönen Gebäudes mitten in Rostock. Es vereint baulich den Wahlspruch der Universität Rostock TRADITIO ET INNOVATIO.
English summary: This is the second volume of a two-volume book that makes accessible for the first time the fundamental historical sources of German private international law from its beginning until approximately 1700, thus providing the essential background for understanding the conflict of laws theory. The two volumes cover the major works of eighteen German authors from 1481 to 1719 in the original Latin and give a translation into modern German. It is an excellent reference work on the history of private international law permitting a deeper insight into present day private international law.
